I'm currently sueing Barclays for bank charges etc, but I've had my case put on automatic stay. I received the letter a few days ago, and only just had chance to get together a reply. Only problem is, the court letter 'stay' day says 17th August, but I only received the letter a couple of days ago. They say I have 7 days from that date to appeal the stay. How is that possible when it's about 3 weeks ago??

 

What can I do?

Appeal anyway and see what they do, or backdate my documents, and blame it on the post system which is what seems to have happened in this case.

 

Don't know what to do. 7 days doesn't seem long enough, to say the test case will go on for years yet! And it was all done automatically without my concent.

 

Please Help.

Hi Danlat,

 

If you post up a brief history of your claim to date, we can follow and help better.

 

If the letter gave inadequate time for you to respond, you could write to Court Manager pointing out that you only rec'd their letter on XXth of September so you COULD NOT object to the Stay in time.
