Just got the results of my SAR from Bank of Scotland detailing charges on my Credit Card. I also received a letter saying that they were exempt from the FSA timetable for dealing with complaints ant that they would apply for a Stay on any court case.

 

From my reading of the FSA/OFT statement the case only pertains to overdraft charges on current accounts, so is this letter invalid and could it be viewed (in a legal sense) as harrasment?

Hi

 

You can ignore the letter from HBOS. Send a letter back to them reminding them that the waiver does not apply to credit card charges. Tell them that you will inform FOS about their deliberate obstruction. Keep a copy for later.

 

Its either a sign of deliberate delay tactics or incompetence on the part of HBOS.

 

Credit card reclaims, bank and mortgage charges are not a part of the waiver by the FSA during the OFT test case.

 

Proceed safely on course.

The bank has no say wether your claim will be stayed. It is up to the court.

 

They do send these letters in the hope it will put people off claiming.

Hi guys, I have been off the site alot recently due to broadband issues and not being at work. I have had my third identical letter from Halifax along these lines, it is an impersonal computerised thing, however I hand delivered a reply to say it was my last and final reply to the letter and I would keep the copies which will be included in my complaint to the FOS including the written confirmation that they denied ever sending it !! Also I pointed out I was not concerned with their court case or what they agree on irrelevant matters to my complaint and I would take my advice and opinion from the FOS and not Halifax. I wonder if the FOS are aware of the banks ridiculous tactics, just proves they do actually think they are the law.

Agreewith above post, but they are getting away with it aren't there.

 

I would have thought by now all consumer forum groups would have responded very strongly about this, but doesnt sem to be the case as.
