In Scotland you can't claim for more than five years, I started my five year claim from the period I got my statements and worked out the sums involved.

 

In Scotland the small claims court only handles amounts up to £750.00. You can claim above that but you may be liable to any court exspenses should you lose the case.

Hi John

 

Hope you had a good time on your hols.New Yorks some place eh !.

 

I have two claims in progress with Hull County Court, both seem to be progressing well. Although I have had a very stamdrard letter saying they will apply for a stay.

 

The woman at the court says that the Judges are reviewing stays, on a case by case basis.

 

I chose Hull because they seem to haven taken the peoples side over the last few months.

 

On my first claim I put my home address in Scotland on the N1 form, I got a letter from the court saying that I needed an address in England or wales for service. So I have set an address on Mymail uk( a company who operates a mail forwarding service). That was last week and I have not heard anything from the court yet.

 

My second claim has gone throgh without them asking for an address in England or Wales.

 

All seems a lottery !!
