      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You have to write to the court, to tell them the claim is settled, they won't accept a phone call. She will get a letter in a few days, just make sure she has all the money refunded first.

 

As for your claim they paid us out about three weeks after they said they were going to defend

just been reading thru yr thread and wanted to tell u to keep yr chin up cos I think yr doing great so far.Yr a bit ahead of me in the process as I havent even filed court papers yet but like u Im also worried that my claim will be the 1st one to be defended but I reckon most ppl would have thought the same thing.Take encouragment from the fact that u won yr mums money for her and if the worst comes to the worst and the bank decides to defend im sure the great ppl on this site will be able to help u prove yr case. I would like to thank you and cathy and anyone else for all the thoughts and kinds words - I know i think i have been on this site since the Beginning of June i dont know what i did before this site its - brill.

I have checked this morning and nothing yet but been reading someone else's thread and that person was only paid out when it was nearly time for going to court - so they have until the 31 August 2006, so all hope is not lost.

Again thanks for the support - My mum is on top of the world getting her charges back. :smile::D

How long do they have after they have sent that letter out dated 16 Aug 06 i got it on the 17 Aug 06. saying that they are going to pay in full.

Libby If I was in your situatuion Id check to see if the money goes in 2morra and if it hasnt Id ring them or write to them stating that their 5 days is up and that you will not stop court action against them unless the full amount is repayed immediately. Ive found your thread very interesting and inspiring and hope I have as good an outcome as you. Have filed my court papers 2day. bethxx

Well Guy's and girl's hope you are still holding on to your hats, cause i rang Halifax (Legal Services), and i spoke to Rachel Hinchliffe (Litigation Solicitor) who was dealing with my case and she said that i normally takes 5 working Days - So i will be staying up till Midnight tonight to check my account will keep you posted.

Well its now 07.10 and nothing in my account, so will check as soon as i come in from work (17.00) it's so hard when you go to work at 8.00am and finish at 17.00 i can't access the internet at work so if there is no money in my account i might catch that solicitor Rachal again.

Well Guys need some advice i am afraid, Still no money in my account and the letter is sgned on the 16 Aug 06 and i spoke to Rachel Hinchliffe (Litigation Solicitor) who was dealing with my case and she said that i normally takes 5 working Days - but i spokie to her again today and what she said was strange that the letter normally states 5 working days but in my case all the letter says is that they have arranged the money to be transfered into my account - she was supposed to ring me this morning but did not so she now says that she will try and ring me tomorrow cause nobody will be they tonight - so my question is how long do they get before they need to put it in my account or would the courts give them 28 days as really they have responded by saying they are putting the money into my account but they just did not say when.
