    • I have just received a letter saying that IDR has been passed a file relating to a debt with Commercial Bank of Qatar. No other details, no specifics. If I don't respond, they will assume they have the correct address (which they do) but say please phone within 7 days. I worked in Qatar 2003-2006 then went to the UAE. I did have a credit card with CBQ and it seems I didn't clear it - visited Qatar a few years later and was barred from leaving the country. Long story short - settled the debt, having negotiated a settlement and the exit ban was lifted. I have heard nothing since until this letter but, as far as I am concerned, there is no debt. I'm not sure I actually have any documentary evidence though. I'm planning on ignoring this to see if anything "official" happens but, as far as I can see, this is long past the statute of limitations of 15 years anyway Should I do anything more?
    • a CCJ does not 'expire' thus does not need any application to a court to 'extend it'. if a CCJ has not been enforced within 6yrs, then it is very unlikely any court would grant such should the claimant return to court, of which the defendant would be advised -( unless they have moved and not informed the court & the claimant such) .  
    • I contacted them when it happened. The caretaker came over, looked at it, and walked off with the tree chunks of mortar. Next morning, they had a roofer come over and enter our garden to inspect it. Friday they were supposed to speak with a scaffolding company. I had to bring up liability and potentially calling the council to report 'an unsafe structure' before they even got moving. They know all about the wedding, the preparations, our patio contractors etc. but their attitude doesn't instill me with confidence. My fear is it will end up being a legal matter which is why I posted here to hopefully receive some advice. As far as I can see, the roof is in a state of disrepair, even if it's just the mortar breaking lose due to the size and weight of the chunks - and even from ground level it's visibly clear that multiple pieces have fallen over time (though never this size so we haven't been able to identify the issue till now - we thought it was rubble left in the garden by the previous owner). Currently, we can't use 25% of our garden due to the risk of more falling mortar which is more than just an inconvenience, we can't proceed with our contractors, and at worst, it will run up in several thousand of extra expenses for us, if we have to find a wedding venue. Even if they do have it fixed in time, and we have to settle for renting a marquee and floor for the marquee and furniture and whatnot it will be additional costs only due to the neighbour's roof.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

i already have had to claims against lloyds settled the first for £4486 and the second for just over £300.

over the last three months lloyds have taken £385 from me in charges...the usual initial charges for minor misdemeanours, and then lloyds deduction of charges creating further charges.:(

so now its time for round 3!!!!

 

sent a letter to privilege accounts manager as they had wrote to me re overdraft above the agreed limit, wrote back informing them that the overdraft of £390 was almost the exact amount they had taken from me in unlawful charges etc etc and requesting a refund. that was on 5th july , but surprise surprise no response. also advised i would pay in £100 every 2 weeks to bring my overdraft back below its approved limit of £100.

 

this week i received a letter from their collections centre , so sent them a letter stating the account was in dispute re unlawful charges etc, advising them of my intending repayment plan. also advised them i was seeking refund of charges etc , and also sent all of the letters to customer services at colmore row which is who i dealt with on my other 2 claims requesting the refund of said charges and putting the account in dispute!!!

 

round 3 well under way.... here we go!!!:grin:

another nice letter from lloyds when i got home today ...advising of another £125 in charges as of august first... :o

 

im not even using the account and they are still adding charges!!

 

it seems that the charges are getting more punitive amd more disproportionate all of the time!!!!:mad:

Just wondered how long it took the second time round and what stage did you get too...I too won a claim but also have incurred more charges since it all began to the tune of £510. I have sent first letter and heard nothing that was 3 weeks ago. Im going to send the second letter next week.

my first claim was settled at court proceedingd but before any hearing for a little under £4500.

the second claim was settled after just one letter, copied from Gary H second claim and ammended slightly, that was for around £300. Looks like i might have to go all the way again for this 3rd claim

my first claim £1500 was through the court system and settled before court date,my second claim was for £500 and settled after the second letter[LBA],and this current claim £200 is now at the second letter stage again,which im about to post off today. i will keep you updated ;)

In the same position. 1st claim (personal) settled 2 weeks before court. 2nd claim (personal) at LBA stage - no response at all to first letter. 3rd claim (business) about to go to LBA stage after usual sod off response to first letter (received just 7 days after initial letter!

you to BD,i dont think it should stop at the first claim. most of us end up paying these horrendous charges usually due to one slip up that spirals into an out of control "charges "disaster. we are all aware of these nasty charges and no one wants them so this is our only way to regain some justice. once you have done one round with the banks it doesnt seem so daunting just annoying,so i would encourage anyone to keep up the good work .....goodluck;)

thats whats happened again here, 1 minor slip up that spirals, i havent used the acount for a coupel of months but they are still adding on charges!!!

Just wondered what you think about the new test case and how it will affect us. Should i carry on with my L.B.A anyway and then proceed to court..luckily its not going to be so expensive this time (£30) to go to court. I guess we will have to wait for over a year to see what happens with test case?

I wonder if we can claim over a years interest if the ruling is in our favour???

May as well keep going. You should be at the front of the queue when the test case is over. Why is the test case going to take so long?

And yes, 12 months worth of interest - at a better rate than a savings account :D

letter received, (well they actually sent it 3 times !!1) ref test case and all action suspended. Complaint number allocated. will file claim with courts a week thursday when i get paid
