      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I see youve had your acknowledgment back off the bank then.

 

What date was your claim deemed served by the Court, I suppose you know you calculate 28 days from it being served not their acknowledgment.

 

Dont really know why they pay some and not others .

there are a few of us on here at the moment that have more or less the same date for the bank to file Defence.

 

I personally have had on offer made but only for half, so I sent a Rejection letter off and the same day thy recieved my letter they had the cheek to put money they offered in my account.

 

I was fumin to say the least, I rang them and told them to take it out as I was going to Court for full amount.

 

The money is still in my account.

 

How long are you claiming for , mine is from 1999.

ARe you going for contractual or the 8%.

 

Just give a yell if your unsure of anything always some-one willing to help, GREAT bunch on here.

 

I Would advise you to read as much a you can then youll get more confidence to face these bully's head on and fight them.

Hi again spoke to someone in customer services yesterday she made me a higher offer which i rejected I have looked on my statement today and the cheek of i halfax have made a payment into my account but less that the last offer any suggestions what i should do.

sorree cant answer your question as I am just behind you, I plane to file claim at court in morning and was wonderin if anybody has any info about adding personal expences to claim i.e. postage ( I had to complain to ICO to get details of charges) stationary time etc. I estimate about 1 hr per letter, including time taken to get to Post Office etc. see Stonedecroze v Halifax2 for details .

Halifax 2 N1 submitted 20/07/07 stayed 24/08/07 N244 Application filed 31/08/07 hearing set for 12/11/07 rescheduled for 29/01/2008. Application dismissed stay still in place.

Charity Group £200 compo for lost passport.

HM revenue & Customs; demand for WTC overpayment £632.12. Disputed, their error. Did not have to repay.

they settled me just after they filed the ackonolidgement, they sent a letter 4 days later that it wasn't there fault and without admitting liabillity that they would pay me up (including intresst and court fees) within 5 days. the money was in my account the same day!

trust me you wont be going to court. my advice is get some holiday brochures and get ready to book within the next 12 days!

the banks are on there arse, ur cruising!

:) Good for you the wynn !! well done, It`s just that I am doing this one for my son and they caused me much aggro and pulling out of hair, not to mention time, consumables and effort and I would rather be reimbursed for this by Howard and his mates than my son :-D

Hi Again

 

First things first DONT BE NERVOUS.

 

Have you sent the Rejection Letter , if not youll find it in the Templates , just send the one that best suits your cicumstances,( if you dont want to keep it that is )

You could tell them to take it back or tell them you'll accept it BUT only in part payment as if they dont pay you all of your claim then youll go the Court route. Its entirely up to you.

 

Take a look at my thread overflow v halifax see what theyve done to me.

Just keep readin more Winner threads then youll get an idea of what to expect.

 

I know its scary and sometimes youll feel like giving up, but dont let them get to you.

 

You will get your money back but its the waiting that drives you nuts.

Dont hesitate to ask if your not too sure of somethin were all here for you.

hi hyg im at more or less same stage im filing my N1 on tues so im in same boat ,, i have heard nothing from them since my LBA ,, yea i was wondering why some ppl get offers before and others dont , guess it depends on whos dealing with it ,, never mind hopefully we all win in the end :) best of luck will keep watching your thread
