Hi Well i sent my letter asking for the list of charges on the 19th.. and i sent it recorded but on the royal mail web site it's still showing not delivered, any ideas?

Tom its well known that if the postman has not logged it as delivered,that it wont show on the website.

Recorded delivery is not what it once was and the prime service now is special delivery which you pay over 4 quid for.

 

I think if you sent your letter 1st class delivery then you can safely assume that within say 3 days it will have been delivered.

 

The banks are not quick to acknowledge reciept of your letter and the first you may hear is when they send you the information.

Got my statements 3 weeks after the letter.

Get ready to have loads of envelopes through the letterbox...........mine came in about 20.....a months statement in each one !:o

Of course Jo you can claim up to 6 years back whether account open OR closed in fact some ppl even trying to go further back !!

 

one of my claims is with RBS and this is closed and goes back to 2003.

Looks like I’m in the wrong thread :confused: as I live in Scotland and the law is a bit different up here. Like I can only claim up too £750 in one go and only go back 5 years Grrrrrrrrrr.

 

I also read Fruitycar’s story and that the case for 8% interest was dismissed:eek: ;-

There are of course some differences between the English and Scottish litigation but I am sure that its all covered within the site.

Both sections have been assisting eachother and I know broadly the differences because I have been curious and keen to read up on it.

 

Our ultimate aims goals and successes are primarily all the same.

 

I am sure that despite your claim being in the Scottish legal system will in no way affect your access to all the info you need .....at least on this site !!

I have just 3 questions i can't find the answers to anywhere on the Scoltland fourm or the FAQ

 

1. With the £750 max in small claims, and you decide to go with as many £750's as you need to get the whole amount they owe you, do you claim the whole amount in your Preliminary approach for repayment. or is it just £750 a time?

 

2. Should i go the whole way and get a lawyer and go the summary route.

 

3. Anyone know if i can claim in an Englsh court and get round the problem this way?

Have you looked at the Govan Law Centre site for your specific questions? They will probably have stuff that is more relevant to you. Do a Google search, as I don't have the URL here.

They cashed the cheque for the £10 fee on the 30th of June

 

I've still had no statements or list's of charges, any advice do i just wait or write again or do i give them a phone?

Any Ideas?

Tom they still have time within the rules.

Theres no reason to suspect that you wont get them......there has been very few cases of problems with this bank.

The fact that your fee has been cashed,and that you have had no requests for further information to support your dpa request would indicate that they are processing it.

Dont forget that most of the banks are now working flat out and in some cases just able to cope.

Their own making of course.

You should look at the 40 day deadline and make a note of that.

Called Halifax direct on 01422 380880 and asked to be put through to Adrian Percy at Business Risk-Retail (this was the person who replied to my data application).

 

He apologised for me not receiving the information and said that the automatic request has failed. So he will get it done manually and should I have it within the 40 day time frame but it might take a few days over that and I could complain about it if I wished.

 

To be honest he sounded really helpful :o

 

So it’s more waiting, as always I’ll keep you guys posted…

To be fair,of the 5 banks/card issuers I am dealing with Halifax have been the most co-operative.

Rbs and city are joint last.
