Right this is a very confusing one, I will try and explian as best I can.

My nephew who is 19 years old and suffers from attention deficit disorder bought himself a motor bike to go to work and back on, however the bike was not running when he bought it, he took it to a motorcross specialist for the repairs to be done, the company wanted £400 upfront and to repair the bike would cost no more than £800. my mother paid the £400 on her debit card from the halifax.

now the motorcross place say that he owes them £771-21p on top of the £400 already paid, they have bike since march, and not contacted him, he has been chasing them about the bike.

My nephew has bought another motor bike now.

The bike place says they have done a full engine rebuild apparently and my nephew went into the place yesterday to look at the bike it is leaking oil, it starts but doesnt drive as they say it needs a new clutch, my nephew asked last week his £400 and bike back as nothing had been done with the bike, the motor cross place aggreed to this over the phone however when his dad went over to collect the £400 the guy who owned the company said your not having it back, you have to pay me everything you owe me. my brother in law who it has to be said has a very short fuse went mad and started threatening the guy, the guy phoned the police and my brother in law walked out, the police were uninterested.

How can he get the money back? or can he get the money back?
