    • I posted a couple of years ago about our debt situation and have been trying to pay off our debt as best we can. It is a possibility I maybe made redundant in a few months time, so I am trying to find out everything I can about what happens in today’s world when you can’t pay. I keep finding conflicting advice on various sites so I wanted to post this quote to get thoughts. It claims basically that the dca will likely get enforceable documents these days and therefore it’s likely you will have to pay dca at some point during the 6 year process.    on here I read a lot of comments assuming the exact opposite of this. A lot of the threads on here state the beginning of the process but I never see conclusive stuff about what happened from start to finish to get insight into whether debts post 2015 have been enforced etc. I hear a lot here not to pay dca companies but most my debts are post 2015 debts I am all up to date on our debts but if I lose my job it is likely I’ll end up where I tried to avoid in the first place. Which is destroying our files and dealing with DCA. I’ll post it below so you can see what I mean.   It is likely that any debts incurred after 2007 will end up with all the documentation being provided and being enforceable. Therefore you should use the time while awaiting responses going through your Income & Expenditure and considering any possiblity of making a full and final settlement. It can take a number of months to reach the stage of a hearing date and exchange of witness statements and normally you would be able to settle or come to an arrangement to pay before the court hearing, once documents have been provided, although this isn’t guaranteed.
    • depends who said sols state their client is. IDRWW vis~IDR(worldWide) are a debt collector regulated & registered in the UK & USA    they are not solicitors. they use various 'for hire' - here use our letterhead paper tiger solicitors. its just a case of who's stupid enough to join their folly. IDR law used to be their fav but they lost do much money, they broke ties after almost being struck off and now do Will/Probate disputes only. IDR Legal are their sols wing. moriarty law Judge and priestly Taheel - a foreign DCA that use absolutely any trick in the book to extort money even pretending to be any of the above inc being the bank themselves in phone calls.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

Wonder if anyone can help with info about claiming from a business account. I've read through the basics and am happy with the process, but am a little confused as to some of the charges.

 

On the statement i'm looking at i have a renewal fee of £2000 and at another point in time i have a renewal fee of £150 - what is this and is it reclaimable?

The charges people are generally claiming back are:-

 

Unpaid charge

Account Control Fees

Paid referral

 

As regards the renewal fee, i can't think what this could be but if it cost ME £2,000, I'd remember it. Perhaps it's do do with renewal of loan or overdraft but I still don't think the FEE woulf be that big.

I've just looked thru that link. I think we'll continue but ignore the renewal fee. I just called one of the no win no fee companies for advice and they say it's a service charge - i'd love to know how it's calculated :mad: but never mind eh?

I think so - the only thing that i'm a bit bothered about is the overdraft interest? It's quite high so well worth claiming back i think.... am sure there's a good spreadsheet somewhere to help me with this though?

I'm guessing here but if it's an arrangement fee for setting up or renewing an o/d, then it's not reclaimable. If it's a charge made because you've gone into or increased your o/d in excess of agreed terms, then it should be reclaimable. Not one I've heard of though.

 

Anyone else know?

Hi Slick

 

I've been doing a little more thinking over this commission charges thing, it's really eating at me lol.

 

In the early days (2001ish) they used to specify what their commission charges were on the statements, they don't do this since 2003ish days. I think i want to write and ask them for a break down as it's obviously information they hold and i think that this is where they are hiding all the a/c control fees or returned direct debit info.

 

I have my original statments and so i'm going to send an SAR but i'd like to specify that this is exactly what i am after and wondered if you had any suggestions on how to word it? I know HSBC do a similar thing with their "total charges" and that business customers are having to find out what this is in order to reclaim their charges so i think it could be a similar situation

Hi Bex,

 

Looking through my B's Small Business a/c state's, there are entries as follows:-

 

There's a quarterly Advance Notification of Charges which shows how the quarterly chgs are made up. Look here for entries like Paid Referral Fees, Account Control Fees which you can reclaim.

 

Up to September 2002, my normal state't ALSO showed the separate reclaimable fees but from 2003 onwards, the state't ONLY shows a single "Commission Charges for the period blah/blah.

 

Look out for the separate Unpaids Out Fees which can show any time when they bounce a pay't - these aren't shown on the qtly Advance Not'n sheets.

 

So before you go back to B's with an S.A.R - (Subject Access Request), see what you've got.

Thanks for coming back to me Slick. I don't have this breakdown of charges - they must have been thrown away (too trusting eh).

 

This is the info that i'm after though - so should i ask for copies of the quarterly advance notification of charges in my SAR.

Bex,

 

I have to correct my reply to your post #6 above.

 

Commission Charges is the name B's give to the total quarterly chgs made to your a/c. Non reclaimable items are, eg, Automated Entries, Standard Entries, Maintenance Fee.

 

Reclaimables are A/c Control Fee, Paid Referral Fee which show on the quarterly summaries. Also Unpaids Out or Unpaid Charge which show on the ordinary state't any time a pay't is bounced.

 

So if you think you have charges from 2003 onwards ( before then they are itemised on the normal state't when the qtly chg is made), apply to B's using the S.A.R - (Subject Access Request).

 

If you do this, ask for state's for all years since the a/c was opened. Then you can d/w the more recent chgs and decide if you should go back beyond 6 years as well.

Thanks Slick - i had a feeling they were hiding something in there - there were so many unpaids and no charges visible - another cheeky way of the banks hiding them i suppose.

 

I'll make the SAR today - thanks again for all your advice.

The link I wanted didn't work but here's an extract you need from the thread by Karnevil headed Business Claims - basic guide- Consumer Action Group which I gave you in post #2 above.

 

Requesting your transactional history

As a business you, or your accountant, should already have access to all your statements. However things happen so if you do need to submit a request for the information from your bank the following should guide you.

 

Sole Trader/Partnership – The Data Protection Act applies in the same way as for a personal account.

 

Ltd CompanyUnfortunately, the right of subject access under the Data Protection Act 1998 only concerns personal data, so you won't be able to use the S.A.R - (Subject Access Request). There are no statutory provisions for right of access to business data..

Maybe someone knows of a more recent link for business a/c's.
