    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Halifax have a huge fight on their hands, I am gonna fight this to the death.

They have made me very ill over the way they have conducted themselves. I am a single mother claiming tax credits, and rely on CSA money every month too. I am claiming 2717 from one account and god only knows from the other, which thay have closed down without informing me. I had an overdraft but as i wasnt using that account they didnt re new my facility, so i went into unauthorised over draft 1300. For months they were delving into my other account and taking wat they could from it to go into the other account to clear my OD. I had all my benefits paid into my card cash account, and they took it and left me with 4 pence. This was happening every week, and funny as it seems, it was a race against the bank manager to see who gets the money first.

By me doing this I was leaving my bank empty and so my DD were not being paid, but they still wouldnt if the bank took the money first.

I cried down the phone to them about this leaving me with nothing, and they said cant you borrow from your family. What a F*&%ing cheek.

In the end the bank realised that i was beating them to it and froze my account so i couldnt get access to my benefits, i was so distraught, they made me very ill, and i could see no end to it. So i opened an account with Abbey, and it feels weird having all my money to myself. So i want them to pay.

I have since received a letter from them that they decline my request and now I have sent a letter back basically saying i suggest you rethink your decision, as it will get messy, in a round about way.

How they can do this is dispicable, anyone else had the same bother?:-o

hi i had the same problem,you ask for help and they dont help or care i nearly had my house taken of me i had baliffs for council tax knocking on my door,had to take my kids to my mums for tea some nights because they kept taking between £200.00 £300.00 from my £600.00 wages amonth i was as single parent and not recieving any money from my ex,wot a bad time i went through,:mad: how dare they i have just started and i am going to get all my monies back this is personel they dont care if you have children or any thing.

Hi Miss Annoyed the Halifax seem to have a way of doing things you send them a claim they reply with a standard letter looking into claim etc quoting we have 8 weeks to investigate etc. When I claimed from them it took approx 7 weeks from prelim letter to payout. As long as you keep it simple they seem to payout ok, I have never heard of them actually going to court against a claim. Though they are now so snowed under you may actually have to file at court before they payout. Check my thread to see that it can be very easy to win claim

Hi Miss Annoyed & welcome, you are definitely in the right place. Last year when they took charges for unpaid DD's I rang them, & a snotty good for nothing answered my call, he was literally telling me how to look after my money, I told him it would have been in credit if they hadn't taken it from me, thats when I immediately wrote them letters of complaint, & naturally got nowhere. I didn't know about CAG, until I did a google search, & I'm very glad I found it, I feel much braver now to take them on, & I intend to win. So very best wishes, & if you need any advice, just shout, there's always someone there who can help guide you.
