    • Sorry for late reply dx been away and appreciate your replies. Yes he has paid the original borrowed amount off but obviously interest on top in which is owed and offer to write off. I know it is only a small amount owing but I didn't know whether to attempt to pursue with reclaim of previous paid amount plus interest. Or just to accept their offer and have removed from Credit File.

    • You were given this PCN because you overstayed not because you went to Starbucks or MaccyDs from the other car park. I assume therefore that the parking time is only 30 minutes as you were recorded as being there for 38 minutes. Given that there is a Consideration time and a Grace period  as well as the time between their photographs of your car arriving and leaving one wonders why they gave you a ticket. Force of habit I suppose. Because they are on airport land which is governed by Bye Laws that supercede PoFA we do not usually look at their PCNs there because in none of them can the charge be transferred from the driver to the keeper  as would normally happen after 28 days if the charge is unpaid and the land is not subject to Byelaws. In your case as they have failed to specify the Parking period  which is the time car is spent actually parked in a parking space not the bit that they include which is driving from the entrance to the parking space and the other bit from the parking space to the exit. As that reduces the lawful time you were actually parked I would suggest that they have breached your GDPR.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sent prelim letter 11th June. I'm claiming for £1600. 21st June received reply asking did I need help managing my accounts (no jus stop charging me outrageous amounts!!) I've got an overdraft so I am a bit concerned that they may ask for repayment of this. Have been reading everything and anything on this subject. I have recently opened co-op account after Lloyds TSB declined me. Any tips, advice, support very much welcomed. Comments on spelling or grammar not!!!!! (you know who you are!)(x)

have today done LBA am posting tomorrow,cant help but worry about n/w/demanding overdraft back once the next stage kicks in coz obviously their not gona pay up just coz ive asked them nicely are they??? are they?!?!?;-) ive become sooooooooooooo addicted to this(sad i know)reading everything i can.

hya my first post so hope im doing it right.iam with nationwide also,i have read up a little and im sending my prelim letter tomorrow,this site makes really good reading but some of the stories are quite scary! did you have all your statements? or did you have to wait long for them?

Hi chrisk7, I know what you mean about becoming addicted to reading through everything you can on this forum. Try not to worry too much at this stage about the overdraft (I was in the same position when I first started my claim with an overdraft, and I was also worried about them demanding repayment), just focus on each stage as it happens, and if anything unexpected happens, just post a message to ask for advice, i'm sure people here will be able to offer you assistance in any event.

panic mode !!!someone posted the letters for me coz i got tonsillitis n cudnt get out,they never got them recorded del!! so will i have to send them again recorded? im gona look a right eejit sending the same freakin letter twice in 24 hrs tho arent i!!!! sorry bluey7 for not replyin sooner,yeh i had all my statements ive only bin with them 4 years so accessed 2 years online which is all i needed coz thats the time scale for my charges.

just an update,rec reply from n/wide re; my LBA, got same standard letter i rec after prelim so court here i come,!!!am gona do N1 form tonight and take to court after weekend,cant help admitting im a bit nervy about it but im determined(ish) to get my money back,ill just be in panic mode for 5 weeks worrying!!!any advice or help would be appreciated:)

Have you got Winzip? I seem to remember it being a zip file when I downloaded it. If you haven't got it just go to winzip.com and download a trial version which you can use for 45 days. Once you've opened the zip file you then simply save each individual document to your pc.
