    • The garages are used - just car currently being fixed.  I have no need of what they offer.  It is conscious trespass - and the law allows. Which is frustrating.  It's just v annoying that they do this. Isn't there a law that someone cannot prevent access to a public highway from private land?
    • The problem with sending it too early is that Jake might try to write something called a Supplemental Witness Statement to undermine yours.  It would be better to send yours right on the court's deadline. The problem is that we don't know when that is.  In 90% of cases it's 14 days before the court's deadline, so 21/06.  However, in the odd case the judge decides differently.  
    • Signs and notes on windscreens wouldn't deter me either. after all. it's private land and very little deterrent to stop drivers from abusing it. A physical barrier, IMHO is the only way you will stop them abusing it.....or, depending on what businesses they are, why not rent out your garage to them, ask them for a staff discount if you purchase anything from them? Whilst it is irksome, how much money have you got to throw at it, and is it really that important in your life? If you were using your garage, different story.
    • Still worried about time order - they have not followed procedures. Looking through lists there are some items not been sent, incorrect leaflets sent.  emails sent and we’ve not received. Texts and emails sent and not completed process. Pages worth.  The worst thing is the phone calls. Not got more than 8 minutes of most.  it’s so unfair.  Have sent them emails offering to pay right back to March. All arrears were paid back.  2 payments since.    what other info do you require from me ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The bailiffs defo don't want to tell me when they are going to call on them, so i presume they are aware of what may happen if they do

 

I will try again tomorrow....

hi just wondering how you all are well heres my update not alot really i have sent everything and i have even email wrote and faxed abbey but nothing all ive got is a letter from complaints dept apolygising why i don't know but they have court bungle has gone it did i think laughs the lot i went through four n half packets of 500 plain paper what did i print send the lot

also over four lots of ink ok it took me nearly 3 weeks of being on here all day so i want to claim back but on seeing the costs form it says about the hours? ghee i don't know what to put any help will do ty do i put in the costs of the postage shock shock that was over 35 pounds well there was that much to send, so i haven't heard anything and really am waiting for a court date even thou i have even emailed and faxed inga, but nothing i havent heard anything at all. 0k thats my update so how are you all

Jeeeze, where do i start on this one, BBC are covering it, Radio 5 live news bubble says they are discussing the "customer who turned the table on the banks by calling the bayliffs in" and TV interview for channel M tomorrow.

 

MEN say they are running the story tomorrow aswell.

 

I am trying to get a link to the radio 5 interview.

not sure if i missed any info earlier, but did the bailiff get your money for you, or did he have to seize all their equipment??! LOL! would have loved to see pics of that!

Manchester Evening News have just informed me that the Baillifs did call on the Abbey today, and they issued a writ?

 

Does that mean the Abbey refused to pay so he has given them a set time to pay?

Just read the M.E.N Article, funny how Abbey say "We will be issuing a cheque to Mr Umaar as soon as possible.", why cant they have given you an exact date on when your cheque will arrive.

I wished the Baliffs had just been able to go in and take their PC's - that would of caused them total chaos.

Not been around for a few days. Husband had another cardiac prob. Wish I could have been around when you had the bailiffs going in. No payment into bank as yet and following a call to them tonight the prepared court bundle may be sent in if no definite date of when money will be in account.

Victory for bank charge dad - News - Manchester Evening News

 

Bailiffs went in yesterday, didn't get any money. He is going back nest week.

 

Watch Channel M tonight, they shoel be covering it between 830 to 10 pm tonight, sky channel 203.
