    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This was more likely to be a scary letter from them purporting to be a SD. They are breaking all the rules by presenting this as an official document

 

I today have just recieved the same SD with blue corner via 2nd class post

about a v.old online catalogue debt i think not been more than 6 yrs tho.

 

As it was all done online I never signed a thing so dont think they'll be able to produce the documents for the CCA I've just sent off

 

anyone know if my thinking is correct

I had one of these in my husbands name he is ill so I had to deal with it I took the SD to my local CAB office they said this is very serious etc so I was so scared I paid £165 to Connaught to have it set aside and then they told me to pay £10 per month I thought Data protection and all that they should not have discussed this with me, anyway I found this wonderful site and CCA'd them on 22nd May so they have now until 1st July, I wondered if I can get my money back??

they sent it next day delivery van addressed to my husband and he rang doorbell I answered and he gave it to me no signature required?
Better than their usual stunt of sending it second class post. It really is supposed to be served in person wherever possible. Have you checked its authenticity. It seems strange that they did not ask for a signature of proof you had received it although if the van driver gave the court a statement all he could say was that he delivered an envelope to you.

Hi Folks,

 

Back Again.

 

You wont' believe it i have now received a ltter from MACKENZIE HALL acting on behalf of 1st Credit.They are demanding payment of the LLoyds/TSB for my husband. They are saying they will take action against him.

 

Do i ignore it or do i sent a CCA to them as 1st Credit and Connaught Collections were sent a CCA bit never responded.

Ignore them. You know you have won now that Mackenzie Hall are on your case. They often deal with unenforcable debts and Statute barred ones. Obviously 1st Credit and Connaught couldnt come up with a valid CCA so rest assured our friends from Kilmarnock havent a hope. If you really want to have some sport with them send them this

I must admit that I am rather bemused as to why this account has been passed to yourselves, as it is in dispute with the **original creditor/DCA** and has been since DATE 2007.

Not only is this a breach of OFT collection guidelines, but also in breach of the Consumer Credit Act 1974 and Data Protection Act 1998

 

My last letter from **original creditor/DCA** was DATE and intimated that my complaint would be resolved on **DATE**, this obviously hasn’t happened.

As **original creditor/DCA** are now in default of my Consumer Credit Act request, Subject Access request and have also breached s10 Data Protection Act request , I consider this account to be in SERIOUS DISPUTE.

 

As you are aware while my Consumer Credit Act request remains in default enforcement action is NOT permitted, under s127 this constitutes a complete defence at law.

 

Now I would respectfully suggest that this account is returned to the **original creditor/DCA** for resolution of these defaults and breaches, as **New DCA** cannot lawfully pursue any enforcement activities.

 

If **New DCA** chooses to ignore my dispute and attempt enforcement, I will initiate legal action and file reports with the appropriate authorities, including, but not limited to, Trading Standards, Office of Fair Trading, Information Commissioners Office, Financial Ombudsman Service and possible court action.

 

I hope that this will not be necessary and an acceptable solution can be accomplished.

 

I would appreciate your due diligence in this matter.

I look forward to hearing from you in writing.

Hi Folks,

 

I have a few questions?

 

I have been really poorly and off work sick and my husband is in hospital,i have looked at the paper to CCA MACKENZIE HALL and it says on the letter i have until 14/12/07 which obviously has now passed.

 

I am abit concerned as i have received a recorded letter to pick up from the post office.Do you think it could be Stat demand ? Can they issue my husband one through recorded delivery?

 

Also as i CCA'd Connaught Collections and they passed it back to 1st Credit does this still stand ? Would i really need to CCA MACKENZIE HALL again when the original DCA wasn't able to produce anything.

 

I have kept all letters etc as proof including the false stat demand from Connaught Collections.

 

I am probably being paranoid but at the moment it would just be my luck!!!

 

I would be grateful for any advise and if anyone else has had the same experience as me. Did you receive a letter recorded delivery?

It's unlikely but not impossible. Anyway your original CCA request still stands and this is sufficient grounds for a set aside of any SD.

Its a trick they have tried on me a few times over the years, best bet is to phone the post office and ask them who the letter is from or what the return address is and go from there, saves a wasted trip to the post office

Did you pick the letter up ? Was it a Stat demand? If so was it a proper Stat Demand as my husband has been issued iwth a flase from Connnaught Collections?

The post office people round my way are very helpful with things like that, you should try ringing the delivery office and see what the man says, they usually have the items on a computer screen.

 

If it is a Stat Demand served whilst the debt is in dispute that is a good reason to have it set aside. They may be trying to serve a proper Default notice on you and then a Stat Demand a week later....
