      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm just looking for the letter for you to send about saying the amount is in dispute and also asked someone else to come and have a look for you ( think the thought of getting bumped scared me ;-) lol )

Thanks for the calming words, think l was just getting a bit ahead of myself, it does seem to take forever and l will send them another email on the 21st to inform them they have only 7 days to comply with my request and then put a complaint in for breach.....

 

lve already looked at the next stage and lm all prepared just waiting for final figures then the prelim is going out to the local branch.....

 

as you can see lve had a response from mjanet and lm going to do exactly as she suggested, although l did tell them on the phone that l was in dispute re the charges, think l'll wait again for them to call.

 

This is all a little scary and l do keep wondering if lm going to be THE ONE who ends up not succeeding, but it gives you hope when you read all the ones who have so far and it doesnt look like its going to stop.

 

Keep me posted whats happening with yours...and of course good luck

Marilyn please do not talk to them on the phone , you have no record of the conversation . You need everything in writing now they have sent it to a DCA.

Its your claim so up to you in the end but I strongly advise you not to do it on the phone.

its funny you should say that coz after l wrote to mechs l thought, what am l saying? you lot are always saying dont talk to them on the phone and l wont and of course they do tend to tie me in knots when they call.....l end up agreeing to anything!!!!!!!:mad:

 

lve no record of a letter from them so need an address to send a letter to, so if and when, more like when, they call again that is the only dialogue l'll enter into with them:-D

If you do get another call from the Debt Collection Agency, it is important that you tell them that the account is "in dispute", and that they must not call you again, and should they need to communicate with you it must be in writing. If they try to argue - end the call and put the phone down.

 

Should they call again, then PM me and I will point you to the next step.

 

I would then advise dealing with the bank by either email or letter. That way you have everything in writing, and what is said cannot be disputed.

 

Keep us posted - and if your questions are not answered within a day, or so, then feel free to PM any of the mods.....or any other forum member who you feel can give you a reliable answer.

I had one of these and while this may not be exactly worded as some more knowledgable.

 

Dear Sir

 

I am writing to you with regard your letter dated **/**/**

 

I would like to inform you that this amount is in full dispute. I am in contact with Cutomer Relations with regards to the sum you claim is liable.

 

I will not be discussing this matter with you until my dispute with the bank has been resolved. May I suggest you contact your client for further instructions

If they ask the bank they will tell them to stop as under the Banking code, they cannot chase any disuted amounts

Sent an email to Margaret Tyler, copies to various people with Prelim letter so countdown begins 14 days from today, 5th July, until LBA....

 

Also emailed the same again re letter from Debt Collectors and asked that they inform the same that until the matter is resolved l want no more correspondence from them. especially no calls, but we will see. asked that she inform me that this has been

Thank you for your email. l have sent a letter to Blair etc asking them to refrain from contacting me by phone, to only contact me by letter and that until my dispute is settled l will not be making a payment. l have also asked them to contact Halifax to confirm that l have a dispute regarding charges.

Although you say they are a Collections Dept it clearly says on their letterhead, Debt Collectors. What is the difference? You also told me in one of your emails that they were the Bank of Scotland but l can see nowhere on their letter anything that suggests this, so to all intents and purposes they are Debt Collectors.

Can you also confirm if a Default Notice has been applied to my credit record, if so l wish you to take note of the paragraph in my letter regarding this and that it is cleared, not just amended or corrected.

It seems to me that you have found a sympathetic ear (is that possible) at Halifax. I hope this works out for you.

 

I am going to use you contact, if I may. I spoke to Leanne in the same department on Wednesday, and she assured me that a list of the charges for two specific periods I am STILL waiting for, would be sent on Thursday. Nothing, nada, buggerall today! It is so frustrating!

 

Anyways, calming thoughts and a dose of BB tonight, and all will be well, I hope!

Received an offer today 390.00 pounds hmmm dont think l'll be accepting that as full and final settlement do you??????

 

Letter was signed by Michael Davenport posted in BIRMINGHAM addressed from LEEDS, how funny is that???????

 

Apparently they havent default me as THEY DONT REGISTER INFORMATION ON CRF regarding charges!!!!!!!!!

 

They've been kind enough to allow me 8 weeks to be happy!!! NOT HAPPY, lm asking for 3,000 not 390 that wouldnt even cover what l owe them never mind what they owe ME!!!!!!

 

so come Monday l think my LBA will be winging its way towards Leeds with a thanks but no thanks on the offer (if thats what its called, ld say it was an insult).

 

So l think grabafax l'll see you in court!!!!!!!!!!!!!!!!

ld just come back here tonight to apologise for not seeing the joke yesterday, think l must have been having a bad day, life, year lol, no seriously to all those that posted, re bunny, sorry if l came on a bit strong.

 

Right now my update am tomorrow sending my LBA by email to all and sundry at grabafax since they arent going to be offering me anymore than the 390 pounds they kindly offered but lm not accepting.....

21st June 2006 - Acknowledgement from HSBC

30th June 2006 - 33 letters arrive - 6yrs statements

01st July 2006 - Preliminary request for £2868.24.

12th July 2006 - HSBC offered me £1995, I declined.

17th July 2006 - LBA sent, now £2970

01st August 2006 - MCOL for £3778 (inc 8% + fees)

08th August 2006 - HSBC defending ....

31st August 2006 - SETTLED IN FULL - Wooooooohoooooo.

Halifax

09th June 2006- Data Protection Act Request

22nd June 2006 - Acknowledgement from Halifax

08th July 2006 6yrs statements arrive.

10th July 2006 - Preliminary request for £1393.08.

21st July 2006 - Halifax offered £115, I declined..

24th July 2006 - LBA sent, now £1421.

16th August 2006 - SETTLED IN FULL - woooohoooo
