Hello, I would first like to say a big Thank you to all who have made this site possible. I have always felt Shabby (i will never call them by another name again lol) have taken the p### with regards to their bank charges, so was over joyed when i found this site back in June 2006. I havent had my own internet connection till recently so have had to read in dribs and drabs via work/friends ect. I am now on line so wanted to up date you all on my progress so to speak.

 

SARS sent 31/10/2006

Request for repayment letter sent 08/12/2006

LBA Sent 28/12/2006

Final Request for repayment sent 08/02/2007

Filed claim 19/12/2007 Court sent it 26/02/2007 deemed served 28/02/2007

Shabby acknowledged claim 07/03/2007, sent "without prejuiced" letter 15/03/2007 offering half of claim value, also included shabbys defence.

Response to settlement offer sent 21/03/2007

AQ Filed and sent to shabby 30/03/2007

Shab have also filed their AQ i know this because i rang the court I have not received a copy of theirs AQ or any thing from the court so am just waiting i have the basic court bundle but know there is so much more to add. Any words of wisdom or encouragement will be welcome as will all advice. Feeling deflated but determined. Will keep you all posted.:rolleyes:

Good work so far.You are at quite an advanced stage so would be good to have a thread in the Abbey bank group.

As Martin says, well done.

 

The court bundle looks complicated, but its not really, and you really have done a lot of work so far, and its nearly over now.

 

Don't forget, that this process has now returned far in excess of £10 million to CAG users, and its only a matter of time before you will be included in that list.

 

Keep posting, ask any questions about anything thats worrying/concerning you, and you will get lots of help, after all, when 1 of us wins, we all win:).

is it normal to wait this long for a court date.

my aq was handed in @ my local county court on the 30/03/07, abbey had till the 10/04/07. abbey have sent their aq in i still have not recd a copy, i rang the court, lady on the phone suggested i sent a letter in as she could not see why nothing seemed to have been done, all she could see was that we, abbey and i have filed our aq's. ive emailed them this evening hope to hear something by end of the week.

 

court bundle is so scary but now making sense.

No response to email so I rang the court today was told both AQ have been passed to the judge on Tuesday 1/5/07 so now i am just awaiting the post man.

It looks more complicated than it really is, and the legal part doesn't need to be fully understood when you first read it. Just get a feel for it at first, and believe me, the more you look at it the more sense it makes.

Its all i do read, read and then read some more better to be safe than sorry thats my motto. Once Ive recd my court date i am asking for 36 hrs of preparation cost because its taken me more than a week to get my bundle together do you think this is reasonable. i feel like my computer and I are joined at the hip.

I claimed 20 hours, some claim, some less, it all depends on how comfortable with it. If you get the 36, let us know, as I may claim more next time;)

Still waiting

My claim is with the judge but due to high amount of claims the court is snowed under. Slowly geting everything in order, this week is all about photocopying, bank statements ect. Nice to see a few member finally get their money back, Well done, you are all an inspiration to us all, still in the struggle against the Big Guns (Shabby)

I rang the Court this morning and was told that my claim has been transfered to the Mercantile Court and notification was sent out to Shabby and I yesterday. Feeling really Nervous but know so will shabs seeing has they seem to pay up quite quicikly once this happens. Looks like i will be getting my Court bundle ready to send. Wow I can not believe the end in near for shabs and I, hehe

hey please reply feeling lonely and nervous, am i doing something wrong? i do not seem to get any replys when i post would be really grateful if someone would fill me in if i am doing something wrong. I PM a Moderater did not mean any offence and i am very sorry if this caused any (MB), i really thought i had abbey bang to right for withholding information. You live and Learn, i am just another eager member wanting my money back

Blysie, RELAX, you have done everything right, have you received the AQ yet? when you do I advise you to seriously consider using the Abuse of Process order for Section G of your AQ, if you need any help with it, someone will be around to help you, sit back and wait now, I bet Abbey will be in touch soon, get a spreadsheet ready for your costs on compiling the Bundle, the court wont need it, but Abbey will want it before paying out.

Blysie, there is a forum specifically fore anyone transfered to the mercantile court

Although I have not looked into the issue, the general feeling is that this transfer is BENEFICIAL to the claimant (you) and should allow a quicker sucess.

Thank you for the replies i recd my letter from the court it states

 

IT IS ORDERED THAT

 

The claim be transferred to Mercantile Court.

 

Dated 02/05/07

 

It goes on to tell me to sent all future correspondence to

 

London Mercantile Court @ the Strand.

 

Is there anything i should be doing other than getting court Bundle ready and reading above thread. Should i also get Costs together or wait for more info from Mercantile court. i know this is meant to be a good thing but do feel nervous as i do not want to be the test case.

Okay, I'm reasonably new to this site. I've been using MSE because I find it a bit more user friendly, however, I'm determined to master this. I'm making various claims on behalf of myself and members of my family. Do I start a new thread for each of them in the relevant sections? And, how do I PM?

Yes, I think it'd be a good idea to start a thread for each person (with different titles, just so you don't get confused!)

To PM go to the blue bar near the top, there's white writing statrting at the left with User CP, click on this and you'll go to another screen, on the left there'll be some blue boxes, one of which will say Private Message (PM) click this and then you can write and send a pm! It'd be useful if you know who you're sending the pm to before you get there so you can just type their user name in!

I have some news at last, spoke to a lovely lady today called Louise at the Mercantile Court, she actually asked me when did i want to came to court she went has far as to offer me a date next week. I declined due to an attack of nerves but did get a date for the 8TH OF JUNE yeah the 8th of June. Louise was very helpful and was also quite firm in the belief I will get an offer soon after they receive the court letter which will be sent out on Monday. She also told me they have to work this weekend due to the all the claims they have received 275 in total after managing to sort 25 out today mine included. I feel quite excited but nervous. Louise also told me to make sure i asked for costs and that the Judge was very nice. I got the impression the Court is on our side, certainly Louise who i cant express enough was really helpful and reasuring. I feel very optimistic.

Thay's good Blysie - the court staff are probably fed up of having to do the extra work and then the banks settling at the last minute!
