      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

I have recently been looking into the chances of claiming back bank charges, and decided it was time to bite the bullet. I think i am even more confused than when i started. If anyone has any good tips on how to start going about this process it would be welcomed.

 

To be honest i don't know if i have a case but i do know the RBS has bleed me dry for years now.

Happy has given you all the basics, so please follow his good advice.

 

As to the question of whether you have a claim. Well, you say that they have bled you dry, so I asume that they have charged you heavily for a while.

 

Anything that they have 'charged' you for, ie going over your o/d limit, bounced cheques, cleared items etc etc are recoverable, and at up to £35+ a go, it soon adds up to a fortune.

 

I know this site is confusing, but the more time you spend here, the easier it gets. Its the same with the actual process of getting your charges back, it gets so much easier the more you look at it.

 

Spend some time here, ask some questions (there are no silly ones, and we've all been exactly where you are dont forget), and you'll be so suprised at what will happen. The people here are so friendly, and will help and support you all the way.

 

There has been about £10 million pounds refunded to members of ths site (and there are others like us), and that only counts those that have done the survey, so the actual figure is much more. You can be a part of that. Its going to take some time and effort, but to get some serious money back from your bank has gotto be worth it, hasn't it?

One question I did have, I currently have all my bank statements back to 2002 as I try to keep them for 5 years then shread them. Can I use these or am I better to still request a copy from the bank?

Hey lass,

 

You can claim back at least 6 years (although there is an arguement for more than this now but thats another story) so you would probably be best to claim them all back unless you know there were no charges prior to the ones you have.

Hi All,

I am claiming £3000 from RBS. have just received my acknowledgement of service sent by a solicitor and they are defending the claim! Starting to feel out of my depth! They really are fighting me on this one!

I wouldnt worry too much. Most of them say they will defend it when you file to court. They will settle before it gets anywhere near a court room

I know how you feel, i am just starting out and feel out my depth already is there any hope for me lol. I am ready to fight as i have had arguement with the bank over my charges for years. I think i am looking at about £2500 which is alot of money

Girls, I know its sound easier said then done but once you get one claim out of the way, you really will get to grips with it. Everyone finds it all daunting to start with and worries they may be made an example and have to go into court but the reality is that they WILL pay up.

Thats a very good point. I'm onto my 3rd, 4th and 5th claims at the mo, all have got to court document stage and I'm loving every minute:D

 

I just consider this whole business as a giant savings account that the banks have looked after for me, and now I am getting a lump sum from all of them.

 

You will be fine, and I promise you, the more time you spend here looking and learning the easier it will become. It wont be too long before your advising the new members yourself, and giving help and encouragement to the next generation of Caggers.
