      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My day in Court fast approaches and I'm really looking forward to it!!!

 

Knowing my luck though it will be cancelled at the last minute.

 

Why did the OFT and FSA have to get involved now......why didn't they wait a couple of weeks???

 

They're not bothered about the likes of me they're more interested in helping the banks make more money. We're going to see the banks start charging for current accounts before the OFT case gets to court so the "man-in-the-street" will lose again!!!

 

Yes I am feeling BITTER but I think I've good reason to!!!

Well what a waste of time that was.

Yeah you guessed........."a stay"

I tried to put my case across but the judge just allowed a stay. He said "if I find in your favour the bank will appeal and if I find in their favour you will appeal, so until the high court case is done it's going nowhere"

 

Why can't the OFT butt out and leave us alone??

 

I was really relying on that money.......now it looks like I'll probably lose my house!

UPDATE

 

Firstly

A VERY MERRY CHRISTMAS

and (all being well)

A PROSPEROUS 2008 to all

 

As to my case.....stagnation!!!

 

A month or so ago I cleared off what I owed on my RBS credit card....Great I thought!!!

WRONG.....RBS rang me and said "you owe us £700+ on your current account"

I haven't used this account for well over a year now.

I explained that this amount was charges they had levied since my claim was stayed back in August. Charges for being overdrawn because they had charged me for being overdrawn making me overdrawn.....you get the picture.

So I said you got no chance of me paying this money, I'm skint.

"But what about your credit card?"

Oh sh*t....crafty b's.

So in the end I put the balance on my credit card and closed the current a/c.

 

QUESTION

When the case is eventually resolved will I be able to claim all these new charges, since the court stay, automatically or do I have to make a new claim???

Oh well "next year" is nearly with us time to forget about the thieving banks and enjoy the festivities.

Hi canobeans, it's nice to see you back online :)

 

Two options really - you could either amend your existing claim using an N244 + new PoC showing the additional penalty charges that you'd like to include (you could do this even whilst the claim is stayed), or you could do a fresh claim for the new charges. :)

 

Can't believe the cheeky so and so's were sneaky enough to get you to use the blo*dy credit card though. Talk about more front than Blackpool prom :mad:

 

The test case starts mid Jan hun, so hopefully the stayed claims should start moving forward again soon.

They are cheeky so & so's! I'm a long time lurker in these forums but thought I'd add a post here. I've been in a similar situation with RBoS passing my account to a debt collector and them threatening to take me to court over the overdrawn balance of my current account. I asked them to do so as it would be good ammunition for me to request the stay of my current account claim to get lifted.

As of yet they've not taken me to court but I hope they do because I'll give them their moneys worth LOL

If in doubt, contact a qualified insured legal professional (or my wife... she knows EVERYTHING)

I was pleased to see today that RBS have had an increase in their profits.....only £10.3 bn though.....whereas I on the other hand made a loss and am still waiting for them to return MY money.

FAIR? .... WORLD? .... OBSCENE!!! .... come on government can't you see what's going on? .... or maybe you're just waiting till they get into a little bit of trouble so you can throw billions of tax-payers money at them too?
