      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

okay. i know all my unlawfull charges as i have worked them out from online statements and ive read as much on the faqs as my brain can cope with. im sending off my prelim letter tomorrow. i would really appreciate any advice from anyone else who has come up against norwich and peterborough.

okay. today i get a letter from them saying they are right in what they have done and i can basically get lost. is it at this point i send my LBA? its such a stupid letter, stating that its fair to charge someone £29.50 for a bounced cheque.... fools.

 

any advice please???

We had the same letter but with offer to pay back 25%, they had already wiped 50% of charges. Wrote back saying would only accept if they cancelled all remaining charges showing on a/c, total of £116. They actually did as they said and paid back, along with cancelling other charges, just a shame that we now feel they should pay back the rest of what they owe us so they'll be receiving another letter.

hmmm. there was no offer on my letter. it was just all policy gumph. i sent them my LBA this week, curious to know what they are playing at. it seems odd that they are being so staunch as im only after them for about £170. i hope they try and push me to court because if theyve taken no one else it may be a load of egg on thier faces for such a small amount.

i love the way they try and make out they are completley within their rights to extort money out of people. no i don't think £30 for returning a cheque is fair.

 

what do others do at this point... advice please! i dont want to accept the offer as i dont agree with what they are saying, and ive already got another account so i dont care if they close it.

hello? i could really do with some advice. im worried that as they are pushing it so hard i will be the one they take to the courts! i dont want to accept this so im going to draft up the rejection letter.

I don't know if you have replied to their letter yet. What you should do is to write and

 

a) accept the 50% as a partial settlement only

b) decline their kind offer to close your account and point out that the Alliance and Leicester were fined by the OFT for closing a customer's account just because they were reclaiming charges. The OFT said the practice was intimidatory and vindictive.

c) tell them you intend to carry on with a claim through the county court (and that their closure of your account will be made known to the judge)

 

and

 

d) open a new account somewhere else

Response to settlement offer.

 

Dear Ms Linnell

 

Thank you for your letter dated 04/05/07

 

I respectfully decline your offer of a “goodwill” settlement and request, once again, that you return to me all charges imposed on this account, totalling £176.50

 

I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. I also reject the further conditions of acceptance that you have attached to this offer, namely the closure of the account in dispute.

 

My Letter Before Action dated 28/04/07 indicates that you have until 14/05/07 to respond before I proceed to the next stage of my request. My deadline remains the same.

 

For the avoidance of doubt, I wish to stress that I do not accept your offer under the terms stated in your letter.

 

I trust this clarifies my position.

try phoning their banking operations manager. he is a very approachable guy. tell him you will only accept 100% and want to keep your account open. I claimed for my son and girlfriend and after 2 letters phoned the banking operations manager, told him 100% or court. he agreed but wanted accounts closed. then son's girlfriend phoned him and had a long chat and he agreed they could keep their accounts. open. take a look at the penaltycharges.co.uk site. most people on their did the same as me. my son & girlfriend received nearly £1800 in refunds.

thanks, sounds like an idea but i think i might be on a track even if it is a little bit all over the place. they send me a brief letter yesterday saying someone was going to get back to me and they are sorry i dont agree. we'll see what happens in the next few days.

Hi hows it going ! I received my letter yesterday from Norwich And Peterborough I am after £850 they agreed to give me £29.50 !!!! am now sending them the LBA letter !! let me know how it goes.
