    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone,

Just thought i would introduce myself to everyone claiming from MBNA, after a very successful claim against the Natwest for just under 4k i thought i would turn my attentions to MBNA, before i start my claim i have to check to see if i have any defualts against me from them so hopefully gonna send SAR on the wekend.

Hi Lee,

 

Refund of charges will generally reduce balance, so that seems OK with you!

 

Also, did you include ID? If not, they will leave it until your 40 days are up and then send you some random statements and a letter saying that they have not treated your SAR as an SAR. They will then tell you they have another 40 days......I don't think so!! If I were you, I would follow up with a short note, referring to your SAR, include a copy of your driving licence for example and say that for the avoidance of doubt, you SAR is to be treated as such.

 

Also, stick ridgidly to your timetable, not theirs!!

Hello all, its been a while since i last postedcuz its been a bit quiet on the MBNA front, however received a letter friday which i was surprised at cuz i didnt send SAR recorded delivery, i was expecting them to ignore it and have to start again, anyway, by the looks its a standard thank you for my letter and they are currently investigating my complaint and that they will provide a full response by 23 April, which to be fair to them is 13 days before the 40 day deadline is up, i am assuming that the full response will be all my statements, we shall see,

anyway keep up the good work everyone and i will let you all know what happens

Hi Lee - you may even get an offer of partial settlement! Did my SAR and they wrote back offering £506 which I have accepted as partial settlement even though I hadn't started the prelim letter. Have now done a rejection letter plus prelim together - good luck!

Hello again, i spoke to a very nice but not very informative lady from MBNA yesterday, about the fact that they said they would respond to my complaint, (not really a complaint but my SAR) by the 23rd April, she told me that they are very busy at the moment, and they are trying to get through the backlog, i reminded her that the deadline for SAR is up on 4th May, and she said the same again that they are busy and doing their best, however, they are not that busy that they have time to send me a letter saying i am £118.20 over my credit limit and i am required to pay it immediately (which is made up of charges and interest) :mad:

at this rate it looks like a non-compliance letter may be in order for next weekend,

Lee am sorry for not picking up earlier - don't hang about, file an N1 on MCOL. There is no further need to procrastinate and frankly, if they are that busy, they ought to look at their recruitment issues. It will cost you £30.00 to do this. You will get this back.

 

Have you sent them a CCA request? This will immediately put your account in dispute? Do read up on it though. If your account is post 04' they are likely to be able to produce the agreement.

 

Have got to shoot off again, but will try and keep an eye on this!

hi Corn, i havent sent a CCA request, cant remember when i took the card out, it was a few years ago, forgive me for being a bit dull, i read something about a CCA request but i thought you did that if your account had been passed onto a collection agency, i will read up some more on this,

i work away all week so i wont be online now untill next weekend, i will keep you updated on a weekly basis:)

Hun, be as dull as you like! All forgiven! A CCA 1974 request is where you ask the creditor to provide you with a true copy of your executed agreement. They have 12 days to do this or they go into default. If they do not provide the document within a further 30 days, they are in criminal default and the debt becomes unenforceable without a court order, or alternatively not enforceable at all unless it contains the prescribed terms.

 

Might I suggest that you have nothing to lose by sending one. It will cost you the £1.00 postal order you need to enclose. It can be found in the templates library, Letter N, if you have any trouble location it, let me know a.s.a.p.

Hi everyone again, well the news is that MBNA have missed the 40 day SAR deadline, so if they can't manage to send that to me within 40 days then that is just shocking, whats the matter with these people!!!!

So the plan is now to file with the courts for the SAR, and also to send off my CCA request, gonna read up some more and sort that out over the weekend, i will be back if i need help (probably will:o )

I just noticed on another thread i've been reading that they mention GVI, i take it they are a debt collection agency, i have received several text messages saying to ring GVI, i have been ignoring them because i didn't know who they were and i thought it might be a [problem] or something, if they are a DCA how can they just text me and expect a reply, when i have had no correspondence by letter by this company or even how much the debt is for, is it just me or is that a bit naughty.

hello, sent off LBA for request of SAR 8th May and also CCA requst, today i received, my statements HOORAY!!!! also by the looks of it their standard letter, saying "Their charges are fair and reasonable, and they stand by them etc. they also say i agreed to their charges in their terms and conditions etc etc and that they do value my custom so they have provided me with my statements free of charge ( however they didn't send back the cheque ) and the have offered me a goodwill payment of £320" ) so i'm going to sit down now with a highlighter pen and add up how much has been taken in charges.

Hello, now we are getting down to business:)

spent today writing partial acceptance letter for the "goodwill" payment of £320, and also my prelim approach for the true amount plus interest at 22.4% full claim going in at £1,167.01. going to send that recorded delivery tomorrow.
