I have recd all mt statements back and have calculated the charges etc over the past 6 years i have requested that these charges be returned to me and have had a letter from RBS offering me £500 to close the matter i have since recieved a letter from Tommy McLean saying that the charges are fair etc and still offering me the £500 as full and final settlement and telling me to seek the opinion of the financial ombudsman service should i talk to the FOS or just file a small claim in the court ??

If you have sent the Prelim letter, AND the LBA, and allowed the timescales for each one - then issue court papers.

 

If you've only issued one letter so far, you have to use the 2nd letter before going to court.

 

I wouldn't bother with the Ombudsman...

Tommy is a very busy guy at the moment. Almost everybody claiming against the RBS has had some template form of reply from him :)

 

Don't worry about it, it's perfectly normal! I was told by Tommy to contact the FSA but I just filed my summons against them in court instead :p

Lloyds Current A/C DPA sent 7th May 2009 Closed and charges wiped Summer 2010.

 

Barclays A/C DPA sent 4th June 2009: no reply, no correspondence as of 2011.

 

Littlewoods Data Protection Act Section 10 sent 09/06/2006 - Fraudulent A/C closed and CRA data removed November 2006.

 

HSBC Default & Debt wiped March 2009 (6 yr Statute barred reached)

 

RBS - Claim 1 - Settled in FULL £766.00 20/06/2006.

RBS - Claim 2 - Settled in FULL £777.95 08/09/2006

 

 

BOS A/C No. 1 & 2

Amount - £586.39 claim plus 8% interest

SETTLED IN FULL 08/09/2006 - CHEQUE FOR £625.25

 

Halifax Visa Data Protection Act Disclosure Received

 

First Direct Data Protection Act Disclosure received

Well i have waited patiently for a refund and now they have messed up big time they have charged me £38.00 for a failed direct debit on a loan that i had with them that finished the month before anyway i have sent the LBA and waited so now i have proceeded with court action will let you know how things progress thanks for your help

am currently trying to claim back bank charges from RBS i am at the court stage and have sent of my allocation questionnaire on 7th January i recieved a letter from cobbetts including a copy of their completed questionnaire i am not sure what it means in other information they have put the words case management directions cannot be proposed until the claimant serves a reply to the request for further information which was due on 2 jan in light of this the defendant may amend its defence or apply to strike out ????? The information they asked for was to do with cpr 18 i sent a letter stating i was not prepared to give any information until the court required it can anyone tell me if i have done right or wrong ???

I have now recieved another letter from cobbetts saying that saying the first 13 entries of my claim cannot be claimed for as they are out of the limitation time the letter also states that RBS consider the court case would fail not succeed but they are offering me a third of what i am claiming as a goodwill payment if i accept i will have to withdraw the claim if not they will send a copy of the letter to the court saying the offer is reasonable can anyone advise me what to do next ????

Have they said why they feel it would fail. IMO sounds like dirty tactics (trying to put you off).
