Hi

 

Can someone help please.

Just found out Barclays are defending the claim i've made. I've recieved a notice of transer of proceedings form the county court, attached to this is a "questionaire" which I have to complete and also enclosed is a defence and counterclaim which has obviously been completed by barclays legal team - can someone advise if I need to visit a solicitor or will I just sigh the bloody thing

Presumably you filed the claim online? The "notice of transfer of proceedings" is issued when the defendant defends the claim. All claims filed on MCOL are dealt with at Northampton County Court. When the defence is entered the claim is then transferred to your local county court. You are both then sent an Allocation Questionnaire to complete within 14 days. This is all pretty standard stuff.

 

Can you give more details in respect to the counter claim (ie. whats it for etc.). If you have been served the papers then you need to prepare a defence. Elaborate please?

thanks for the quick response.

 

Basically barclays defence and counter claim is stating that because the claim is for unauthorised borrowings, "paid referral fees" going over an autorised overdraft fee etc.

 

The questionaire is an "allocation questionaire"
