    • So a little update.  I sent a complaint to ico and have heard nothing. I just got the general reply email and that's it.  Sat twiddling my thumbs and thought about what I should do next. I searched for the CEO of Studio but then found that he'd left so as keep getting letters from studio about the arrears etc. I thought I'd email the David Twigg. Sent him all the bumpft and a copy of my original complaint and sars request.  Got no response. So didn't know what else to do. Then I thought I'd try through the financial difficulties option on the online form. One last try before I just give up and let them default me.  Then on the 5th June. I got an email from their customer services. That the items that had gone AWOL have all been cancelled. Nothing else on that email, so I had a look in an email account that I don't use anymore and there was an email from the customer service.  That they were sorry for the problems I've had for the last 9 months. That the sars info was emailed to me on 14/04, it wasn't I've kept all spam and deleted emails on that account, they have raised a complaint with their studio pay team regarding the issues, balance dispute, fee's and my credit file. They are hoping to resolve in 3 days but they have upto 56. They also said in regards to my other issues I have to raise a complaint with studio retail but haven't told me how I do that.  The sars info only goes upto the end of December 2023. It has my previous complaints on there but nothing after so I don't know how I get hold of that information. Luckily I've kept copies of every time I've contacted them. Every web chat or social media contact.  Apologies for the extremely long post but I wanted to add everything I could just incase.  I have checked my account balance and it's still minus 900 odd pounds but I'll keep checking to see if it's all cleared and on my credit file.  I'm hoping this is the end of the whole debacle and they close my account because I never want to do this again. Although it's been a learning experience.  Thanks to dx100uk for pointing me in the right direction. Much appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

ok guys!! i have sent my second prelum letter... (my local branch and head office) - giving them 14 days to reply.. which i know they wont, or put my charges back on to my account!! **** Excuse my language!!

 

so lets wait some more... YAWN!!! :)

ok guys!! today is there 14 days up!! called my bank... no use!! they cant help me, as my branch dont deal with it?? the leeds branch does!!?? all i can t=do is send them a complaint letter explaining there late and wait!! AGAIN!!! how long does this take!! it betterbe all worth it in the end!! xxx

Don't bother with the branch as it will all be dealt with by the Advice Quality Unit in Leeds. Time now to send your LBA.

havent sent them another letter before action letter yet... as i have spokn to the financial ombudsmen now, hopefully they will pull teeth out the clydesdale bank now... sent them a copy of all of my letters i have sent to the bank and all the letters i have recieved from the bank including the copies of my charges which are all highlighted!! they also asked me for my first reference that was on my first letter from the bank, im sure it will all be in safe hands now??

 

i dont still send the bank my LBA now surely??

If FOS are dealing with it now there's no need.

ok guys not happy!!! just came home from work and noticed a letter from the bank with a check for £200 when my original claim was for £1642.. and as abouve the FOS Are now in control with my claim as of yesterday x what do i do?? gutted!! :(

i have just spoke to the FOS regarding my complaint to the clydesdale bank.. and explained about the stupid check for a riddicoulus ammount of £200!!! i faxed them the letter and copy of check, they have told me to send the check back with a leetr explaining im not happy and not accepting blah blah blah!! any template letters for this?? xx

Yes there are a few letters for rejecting offers and they can be found in the template library.

Found one!! PERFECT!! sent it recorded delivery to day to the solicitors and the bank (solicitors being - the letter i recieved yesterday on behalf of clydesdale bank with the check offer and the check!) so i sent the check back to the solicitors!! xx lets see what happens now x

a quick update x

 

ok guys!! i spoke to the FOS about my claim, they told me to send the £200 check back to the bank /solicitor last month which i did, they were going to try and get me the full amount instead!! they have been in touch with the bank and there now refusing to give me any money!!!! so its now in the banks hand to supply the FOS Detailed reasons why they should not be giving me my money back!! :sad: this could take up to 6 weeks!!! - if all fails i will take them to court!! i will have all the info i need by then!! its soooo obvious they are in the wrong!!! x x

Do not be detered by them, like me you have tried to do this out of the courts. Like me its time to use the Courts!

 

I will start my claim in the next couple of days, I am actually looking forward to it.

Still waiting for the FOS to get back to me.. there still on the case to the clydesdale bank, shouldnt be too long now, they have up until 6th of august to get back to me/FOS! If they dont get intouch by then, i will be filling my papers for court!! :)

Hi Pitman, Thats good progress.Have the FOS been good at keeping you up to speed so far? Are you hopeful the FOS will be able to do it for you? At least if it doesn't work out you'll have the court option to follow I suppose.We are still waiting on statements,which are extremely late and we have complained to Information Commisioner.We intend to go down the FOS route as our costs look very high,but we suspect it may be ages yet before any progress is made.CB seem very difficult ,but that does not surprise us given how unhelpful they've been to us over the years. i have just spoken to the clydesdale bank, 0113 231 5038 - Mr Ian Livingstone (not to sure what department he is in) but they are the ones dealing with the FOS claims! he said my case will DEFFINATLY be dealt with within two weeks? they will contact the FOS with a settlement - (the ammount of my claim i hope) then the FOS will contact me... to see if i agree with the amount the Clydesdale bank are willing to credit back onto my account, if i agree... then they will contact clydesdale again explain i am happy with there settlement figure, and EVENTUALLY, the money should be put into my account withing the next few days after!!???

Regarding the interest you need to inform the FOS of this by way of a call or short letter and they will update your file.

Havent spoken to CB since FEB as FOS have been dealing with it but may decide to phone this chap and ask where my money is, i know it wont speed anything up but will make me feel better giving him my opinions of them.:D

just spoken to the FOS AGAIN! Spoke to them about claiming back interest, i have to wait till i get my offer from clydesdale bank, if im not happy with the offer and i want to claim back interest i then write a leeter to the FOS asking them to contact clydesdale again with regards to another higher offer with my interest added on!! :) thats now 6 weekd that the FOS have been waiting on a responce from the clydesdale, i believe that was there limit... shouldnt be long now (i hope) xx
