    • Morning dx and thank you for your message.   With regards to your comment about them not needing to produce the deed, the additional directions ordered by the judge included 'a copy of any assignment o the debt or agreement relied upon'  so that is why I thought that point was relevant?
    • Sorry for the long post but I don't want to miss out any relevant information: My wife bought a car from Trade Centre UK and have been having nothing but trouble with it. Unfortunately we paid of the finance used to buy the car as we weren't expecting this much trouble with the car as we we though we would have protection as buying from a dealer. We are wondering if we can still reject the vehicle since the finance plan has been paid off. Timeline is as follows: 13/12/2023 -15/12/2023 Bought car from Trade Centre UK for £10548 £2000 deposit paid on credit card on 13/12/2023 £8548 on finance from Moneybarn (arranged through Trade Centre UK). picked up car on 15/12/2023 Also bought lifetime warranty for £50/month 25/12/2023 Engine Management Light comes on. The AA called out and diagnosed the following error codes: P0133 - Lambda sensor (bank 1, sensor 1) Oxygen Sensor. Error Message : Slow reaction. Error sporadic P0135 - Lambda sensor heat. circ.(bank1,sensor1) Oxygen Sensor. Error Message : Component defective Due to it being Christmas took a few days to get through to them but they booked me in for 28/12/2023 to run their own diagnostics. 28/12/2023 Took car in to Trade Centre so could check the car – They agreed it was the Oxygen Sensor and Booked me in for repair on 30/01/2024. I was told they had no earlier slots, and I would be fine to carry on driving car when I said I was afraid of problem worse. During diagnosing the problem, they reset the Engine Management Light. During drive home light comes back on. 29/12/2023 - 29/01/2024 I carry on driving the car but closer to the date, engine goes to reduced power every now and again – not being a mechanic I presumed that this was due to above fault. 20/01/2024 Not expecting any more problems paid off the finance on the car using personal loan from bank with lower interest rate. 30/01/2024 Trade Centre replace to O2 sensor (They also take it on a roughly 60mile road trip which seems a bit excessive to me – I can’t prove this as something prompted me take a picture of milage when I handed car in but I forgot take one on collection – only remembered next day.) 06/02/2024 Engine goes in reduced power mode again and engine management light comes on – Thinking the Trade centre’s 28 day warranty period was over I booked the car the into local garage for the next day to get problem fixed under the lifetime warranty package. Fault seems to clear after engine was switched off. 07/02/2024 In the Morning, I take it to local garage who say as the light gone off – the warranty company is unlikely to cover the cost of the repair or diagnostics and recommend I contact them when the light comes back on. In the evening the light comes back on and luckily I manage to get it back to the garage just before it shuts for the day. 08/02/2024 The Garage sends me a diagnostics video showing a lot error codes been picked up by their diagnostics machine including codes for Oxygen sensor and Nox Sensors, Accelerator pedal and several more. Video also shows EGR Hose not connected to the intake manifold properly, they believed this was confusing the onboard system as it is unlikely this many sensors would trigger at same the time but they couldn’t be certain until they repaired the hose. 13/02/2024 Finally get the car back as it took a while to get approval and payment for the repairs from the Warranty company. Garage told me to keep an eye the car as errors had cleared with the hose but couldn’t 100% certain that’s what caused the problem. 06/03/2024 Engine management light comes on again. Fed up I go into Trade Centre as I was just around the corner when it happened and asked them how to reject the car or have the problem fixed. They insist that as it’s over 28 days I need to get the car fixed under the warranty package I purchased and they could no longer fix the car as it was over 28 days. When I tried telling them it appeared to be the same or related problem they said they couldn’t help as I hadn’t contacted them earlier. I asked them if they were willing to connect the car to the diagnostics machine and tell me what the problem was, as a goodwill gesture, which he agreed to do and took the car to the back He came back around 30 minutes later and said they took a look at the sensor they replaced previously and there was nothing wrong with it and engine management light went off when they removed the sensor to check it. When I asked what the error code he couldn’t give me an exact fault but the said it one of the problems I told him earlier (Accelerator pedal). I have this visit audio recorded on my phone – I informed the reps I was recording several times. As the light wasn’t on, local garage couldn’t book me for a repair under warranty. 07/03/2024 Light came on so managed to book back into local garage for the 12/03/2024 Whilst waiting to take car into garage, I borrowed a OBD sensor and scanned for errors on the car. This showed the following errors: P11BE – Manufacturer specific code (Google showed this to be NOX sensor) P0133 - Oxygen (Lambda) Sensor B1 S1: Response too Slow 12/03/2024 Took car to local garage and the confirmed the above errors. This leads me to believe that either Trade Centre UK reps lied and just reset the light or just didn’t check properly (Obviously I am unable to prove this) 22/03/2024 Finally got the car back as according to garage, the warranty company took a long to time to pay for the repairs 28/04/2024 Engine management Light has come back on. Using the borrowed OBD scanner I am getting the following codes: P0133 - Oxygen (Lambda) Sensor B1 S1: Response too Slow P2138 - Accelerator Position Sensors (G79) / (G185): Implausible Correlation I have not yet booked into a garage as I wanted to see what my rights are in terms of rejecting the car as to me the faults seem related. I can’t keep using taxi or train to get to work every time the car goes into the garage as it is getting very expensive. Am I right in thinking that they have used up their chance to repair when they conducted the repair end of January or when they refused to repair it in February ? If I am still able to reject the vehicle could you point to any sample letters or emails I can use. Thankyou for your advice on my next steps.
    • Ok noted about the screenshot uploads. In terms of screwing up I had one previous ticket that defaulted and ended up in a CCJ from Southend airport because for some reason during COVID I didn't receive their claim form just a notice of default. This hospital ticket was the 2nd ticket that went to CCJ due to a lack of knowledge of the process. Maybe it's easier just to pay them in future I'm thinking though, I don't get them very often anyway

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

As I'm still waiting for Halifax to send details of all charges over last 6 yrs, I have started to record the charges I do know on the spreadsheet I found on this site. Gives me something to do whilst waiting! I just want things to get going!

Oh and I have emailed someone in Customer Services Legal Dept asking why I haven't heard that they have recieved my request and £10 (of my hard-earned money!!) - haven't heard yet tho!! LOL!

It is now almost 4 weeks since we sent the SAR and £10 to Halifax - no acknowledgement that they have received it. I know they technically have 40 days to act on our request, but why do they make us wait like this? I just want to get on with things! And what happens if they don't send the evidence of charges etc?

By the way, I have phoned and emailed also in the last week and got absolutely nowhere - no one replies to me :(

Oh right, so as we sent the SAR on 12th March , that would mean they have until around 21st April to act on our request, and not until 7th May as I originally worked out?

Well what a bunch of plonkers the Halifax are!!!!!!

I phoned today in response to a letter we received a couple of days ago regarding the first letter we sent (that is the one I sent before coming to this site and finding out how to do it properly!). This is the second letter aout my original letter and it says that they are sorry they still haven't given me a full response to my concerns, but they will reply by 1st May.

So as I haven't heard anything from them in respect of the SAR and £10 I sent on 12th March I thought I'd phone the no.on top of this letter (08457253519 - Customer Relations).

WELL........can you believe there is nothing on file/account about the SAR I sent, but she said it might be still in the system and waiting to be logged. At this point I made her aware of the first letter I sent at beginning of March, to which I have had 2 replies......and GUESS WHAT??!!!! No record of that on system either! **&&???!!

With that she put me on hold and spoke direct to the dept dealing with these things and then told me that they have had so many to deal with (aaaahhh!!!!) that there is a backlog and I will probably hear from them in next few days.

I told her that if they don't send me the info by 21st April (40 day deadline) then they are in breach and will be getting the next letter from me anyway.

 

What bunch of complete inefficient jerks!! This only makes me more fired up to take them for all they owe me....every last penny!!!!!

OK, so I'll reply to myself cos am bored at work and still almost an hour to go!!!!

I guess the Halifax really don't know what they are doing and don't even seem to be capable of keeping accurate records of what is happening with their customers.

And I'm SOOOOOOOOO frustrated waiting for the damn info to come thru!!! I just want to get going on it! I guess it's what everyone else has experienced.......

Am STILL waiting for them to act on SAR and send me details of charges etc. They only have until 21st April tho!!

In the meantime me and my husband are having a bit of a time with them over an apparently failed d-debit they have charged us £39 for. I say seemingly because the d-debit was not actually set up on the account at the time they say they couldn't pay it!! Now they are harrasssing us....phoning almost every day....because we are £72 (yes just £72!!!) over the overdraft limit and that is because of their charges I might add. We haven't used the account sonce Nov last yr, when we set up a parachute account. They were bleeding us dry with £300 of charges each month and no way of getting on top of things - we had to move our money away and start to recover financially. So you can imagine how angry we are that THEY have made a mistake and expect us to pay.

The ovredraft amount is £672 and we just don't have the money to clear it. Once we get our charges back they can have their money and we're finished with them.

My husband speaks to them when they phone and their latest tactic is to hang up on him (although they phoned in the first place!!) when he goes on about the mistake they made and the fact we won't pay them another penny more when they insist on 'stealing' it in charges.

Anyone else had this strange treatment from them?

send the a letter recorded of course telling them that the account is offically in dispute, and ALL contact is to be by letter in future, and to no longer phone you, if the phone you you will complain to the police about harrasment. that should get their attention and stop the calls :D

I found that letter and have sent it to them today. It should make a difference then.

Will also phone Customer Relations in the week to ask about my SAR and WHERE IS THE INFO I ASKED FOR?!!! Just want to get going on it!

Today we received a letter from Halifax offering £6,000 as full and final settlement. This relates to the first letter I sent (if you read my thread this will make sense!!) with an 'estimate' of £6,000 of charges. However, since sending that and coming to this site I realised we are probably owed more than that and have sent SAR and £10. The SAR hasn't been acted on at all.

This evening I phoned the named person on the letter (Graham Neale 01977 627185 - Customer Relations) and I have to admit he was very helpful. I explained about sending the SAr and not having received any statements yet, and the deadline being this coming weekend. Straight away he said he would get on to it and have them sent out to us immediately!!!!! I did say to him that we reckon the overall amount we will claim is more than £6k and that we would get back to him once we have recalculated everything - obviously still within timescales etc. Am just feeling glad that things are now moving and I can see the light at the end of the very long tunnel!!

Yes things are going right for you,but hold back from accepting the offer unless you are entirely satisfied.If your claim goes to court, you win and then interest will also be added. I put that because if you had invested the money you would have gained interest; so why not claim it now? I would start preparing a court bundle;

I need to calculate all the charges first and then decide if they come to more than £6k, which I suspect they will do. Then I'll know what to do next.

Will keep posting on here as I'm sure I'll need more advice soon!

Not sure what to do now...........

You know I said that we had been offered £6,000 by Halifax? Well I phoned and explained that w estill waiting for statements etc as I only estimated £6,000 but think it's actually a lot more in charges. We are STILL waiting for statements (I phoned them again today to hurry up) - but today they put £6,000 in our current account!!!!!!!!!

NOW - does this mean we can still claim for the rest - I reckon there's another £4-5,000.

I'm kind of thinking we carry on as we planned to - but their letter said it was 'full and final offer' and they wouldn't give us any more money.

Am confused......PLEASE HELP!! :confused:

The only letter we sent originally was off the MSE website (before I came here) - the one where you have so many yrs statements and estimate the 6 yrs amount to claim from the figures you do already have. Great - only I didn't estimate right, did I? Being as they stumped up exactly what I asked for in the letter - am amazed about it - but does that mean I can't claim the rest?

15th May 2007 - £2,500 offered over phone (full amount asked for is £5,300) - OFFER DECLINED.

 

17th May 2007 - Filed claim via MCOL.

18th May 2007 - Claim request issued.

 

Notice of Issue received from Court - 22/5/07.

Claim deemed to have been served as of 23/5/07.

Notice of Acknowledgement received from Court - 31/5/07.

Halifax now have until 20th June to file defence or whatever......

Hi Deb

I would send the rejection letter which can be found in the template library and accept the £6K on a partial basis only and when you eventually get your statements, you can claim for the total of your claim + interest less the amount paid on a/c leaving a smaller balance.

Thanks Ds, but I can't use that template yet because I don't know exactly what the total charges are that I'm claiming.

I guess I just have to hope the statements etc come very soon. The guy I spoke to today seemed to think we should have them by now.......and so the wait goes on......and it's also after the 40 day deadline now too.

don't accept it at all, theres a few problems accepting may bring up in the future,

1. when you claim the rest, which charges have they already paid back? the first £6000, the last, or 1 for here 1 from there?

2, if/when it gets to court, if they say the first then you'll lose loads of interest.

3. if you go for contractual interest then you'll have lost even more.

theres likely to be other problems as well but i can't think at the mo, v tired:)

it's for you to decide whats best for you, but thats what i'd do, it's still early in the process and if they've offered that much already then they've had a look at your charges and think it's worth it, just think how much they really owe you:eek: . write a letter telling them you don't accept and to remove the money from your account, and get a move on with your S.A.R. request,

once again thats what i'd do.

ps i'm skint so i would be tempted;) but i'd gain confidence from an offer that BIG this early.

Well that's sort of what I'm thinking. If they paid out £6k just like that, they must know exactly how much they owe and think they are getting off lightly, if we will accept that amount.

Am wanting to go for the rest - definitely - it's just knowing the best way to go about it, and I don't know much really!
