      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello All ,ive got my statments from studio and worked out what they have charged me :mad:,but i just know need to know what sort of prelim letter to send?? :?: and where to send it?

would it be the same as the one's we send for the bank charges??

Yes just use the same template and doctor it in places. I sent my prelim letter to them and they repaid my charges in vouchers less than a week later. I know some people dont like vouchers and want a cheque but as it was the month before Christmas I used the vouchers. All £250 of them. I bought a bit more and once I have paid it all off I am going to close the account.

 

They were the quickest out of all the banks/credit cards I have delt with over this.

Did you claim PPI?? im not sure if i can add this to my other charges ( sevice an admin charge )

 

Ive added the whole lot up with the PPI and it comes out as £598 :o which was a lot more than i realised.

Just hope that they well be as quick with my claim as they was with yours

I dont mind vouchers as i can pay of my bill with them and use the rest with other things :D ( mind you a cheque that size in my bank would be better )

I didnt claim for PPI as I wasnt being charged for it. I am not sure if you can claim it but I dont think it would be hurt if you added it to your letter.

 

From reading other peoples threads on Studio they have been very quick and accommodating with everybody. Some of the big banks could take some lessons in customer satisfaction with Studio!

 

I had a zero balance when I claimed so I think that is why they sent me vouchers, with you having a balance they might take it off. Which would be better! But yes, nothing beats a nice fat cheque!

I just sent Prelim to Studio yesterday giving them 14 Days. I did include PPI as I believe I did not agree to it. However it has been suggested to me that it is something you have to opt OUT of. So we shall wait and see.

dont remember ever agreeing to it anyway.

Ive just got to wait and see what they say about it.

From what ive read it doesnt take very long,and they are a lot quicker than

the banks.

 

ill race ya to see who gets there money back first!! :D

Just a little update just looked at my Studio Account and it looks like they

have credited my Account with £180 ( they have taken it off my balance )

I'm claiming a lot more than that!! :mad:

Do you think they will send the rest in vouchers??

Hope they don't think that i'm going to settle with this meagre amount

What do i do now??

Like you say the money would be better in your bank.:shock:

I haven't received a letter from Studio yet?

I'm not sure why they only paid me £180? to be honest it's made me think that I've made a mistake :confused:

I'm going to go through my statements again.

If i don't here from them next week I'm going to send off my LBA letter

and then see what they do!!

 

Anyway I'm glad you won your claim.:)

Hello All :)

 

Just a quick update, i got a letter from studio this morning saying that they have offered me £261.70 and have taken it off my balance.

 

When i checked my balance it seems a lot different to what they say it should be :confused:.

 

They also said that they wont be refunding my PPI ,even when i take of the PPI my claim amount still adds up to more than they have offered.

Should i now send them LBA with a new amount ( minus the PPI ) and not accept the GOGW??

 

Hope someone can give some advice on this, as it will be a great help to me :)

Send LBA then give them 14 days.

 

I got my PPI back it wasnt a great deal but I stated I did not agree to it and was not made aware of opting out if I had too.

Hi

I am just about to start a claim with Studio.

Can you please let me know what you claimed back, the service charge is a complete con, they charge you interest on your balance, and charge you interest on your order!

Also when you order lots of things, they send them is loads of different boxes so you have to pay postage and packing loads of times.

I know what you mean about the P&P,its a complete rip off :mad: but I'm not sure if you can claim that back.

When i asked for my statements i enclosed a £10 postal order,but was told by Studio that they don't charge for them,and the credited the money to my account.:-D

 

I must admit tho,Studio are very quick, i got my gogw within 5 days

even tho i was happy with it,i thought it was very quick.

I'm going to send them my LBA today ( recorded delivery ).

 

So now i have just got to wait and see what they come up with,i don't think there very happy about me claiming for the payment protection

but seeing that i didn't agree to it in the first place,i should be entitled to get it back. :)

Sent off my LBA yesterday,and Studio for it today, so i checked my account

And low and behold they have credited my account with more money!!

But still not enough :mad:

I also asked if they could NOT refund it to my account and that want it

sent to me by cheque!!

Are they stupid or wot,it's not that hard to print out a cheque and send it to me.:)

 

Come on STUDIO its not rocket science just send me the blimin cheque.
