    • Hi Guys, well a year on and my friend has just received this in the post today, obviously a little scared so looking for more of your advice.  Letter from the NCC dated 1-May-2024 is as follows.......   Before deputy district judge Haythorne sitting at the national business centre, 4th floor st Kathrine's house Northampton Upon reading an application from the claimant  it is ordered that  1. The claim be sent to the county court at #### (Friends local Court) Because this order has been made without a hearing, the parties have the right to apply to have the order set aside, varied or stayed.  A party making such an application must send or deliver the application to the court (together with any appropriate fee) to arrive within seven days of service of this order.  If the application is one which requires a hearing, and a) the party making the application is the defendant: and b) the defendant is an individual, then upon filing of the application the claim will be transferred to the defendants home court.  In all other cases requiring a hearing the claim will be transferred to the preferred court.    As a result of an order made on the 1 May 2024, this claim has been transferred to the county court at ##### (friends local court) 
    • I am heading over to hers tomorrow so I will find out.  Will there be something written in the agreement or does it depend on the agreement its self ? Just so I know what to look for, so I can provide as much information as possible on here. 
    • The answer to this is going to depend on what the agreement your friend signed says. Or contact the housing provider and ask them.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well, I have started the ball rolling here and have sent the SAR letter by recorded post. I had my bank acc closed 18 months ago and have lots of charges up till then, can't wait till the statements come back......:) :)

Good luck. Seems that they have different practices for sending out the statements - some people get them quickly (by courier) and others have to wait. Good luck with your claim by the way.

Well my statements came yesterday and it works out to £3000+ for overdraft fee and excess overdraft fee. Not many recalled dd/so so I should not expect that arguement from them.

 

Prelim being prepared now. :)

Excellent make sure that once you send it that you stick to your timescales and don't be put of with letters saying that FD are investigating the matter and will get back to you in 8 weeks etc!!

Prelim was sent on 31st March, by recorded delivery of course!!

 

I got the standard letter yesterday (5/4/07) saying that they will reply in 10 days.

 

I decided not to claim debit interest as I found it too difficult to work out the difference from the interest on the charges and the debit balance. I will add the 8% later if it gets that far, which I'm sure it will in view of the amount I'm claiming.

 

I guess I had better start preparing my LBA now!!!:|

Eeek, LBA due to be sent now. Will prepare later today and send on Monday recorded.

Nothing yet. I'm getting LBA letter ready today to send Monday, got behind with this claim because I've been doing AQ for barclays and N1 for mbna. Although mbna want to settle monday morning, so they've got til lunchtime then I go to courts.

Well I sent off the LBA on Wednesday 18/4 albeit a couple of days late as I've been dead busy with work.

I had an offer on Monday from FD, offering £974 from a £1,147 claim. Considered it for a while decided against excepting. LBA already in the post, rejection letter going today.

 

Good luck, hopefully you'll get an offer soon.:D

I received a letter today from FD saying that FD do not agree with my contention that the charges are unlawful and then went onto spout the T's & C's. They then say that are unable to agree to my request and if I wish to escalate I can write to Robert Kernaghan, Customer Relations Manager.

 

I think that this is a standard letter, has anyone else had this one? It maybe that they have not made an offer as its over £3.5k. What do you all think?

Im claiming similar amount to you, my LBA runs out on 7th may, as yet I have heard anything other than the same letter you have had ie ..........if I wish to escalate I can write to Robert Kernaghan, Customer Relations Manager.

Just wondering if you have had any other contact from them?

I got standard sorry letter will respond within ten days. Then I got the 85% offer after the ten days which sent rejection letter to them they got that last saturday and I received 100% offer yesterday.

Well guys, nothing from FD so far. Not even a measly offer :(

 

Now I guess that I have to do the MCOL or N1 which looks a bit of a nightmare from others' comments.

 

I have looked at the templates to see if there is a letter saying something on the lines of.....'pay up within x days or I will add another grand interest plus court charges etc....' but couldn't find one. Has anyone got a letter like this, I'm sure I've seen one on a thread somewhere??!!

I made a point of telling them that if they didnt pay up it would cost them court fees and interest and if they were relly interested in managment cost and time they'd pay up also I was cheeky and said if they put in a defence just to delay things I would put in a Wasted Costs Order! Not sure if it heled at all but they paid up in full!!

Hi All,

 

Apart from being busy at both my jobs (day&night/weekend!!) I have put off doing the MCOL/N1 as I had lost my bottle. I'm not afraid to say that I'm terrified of the one that has to go to court :o

 

I know this is silly as no-one has had to do it - so I have to get back on it. They owe me loads of money!!!! :mad:

 

I finish my day job for the summer tomorrow so the first thing I am going to do is pick this back up again and go for all the others too to get as far as I can before September when it all gets manic again!!
