    • I received several letters from J&P which were just ignored, but now I've received the same paploc Eve appears to have. As it stands, I'm looking to complete & reply as per the oft-referenced thread #5. After reading a few comments about ignoring and nothing progressing from J&P side, I'm intrigued whether they were just general 'please contact us type letters' or letters of claim/paplocs?  I realise for some it's a personal decision or based on advice, but given advice on here is not to ignore paplocs, what was the reasoning to ignore? 
    • Afternoon All. I have today received a court order requiring me to send them more details before 16:00 on 8 July. A copy of the order is attached, but the relevant paras seem to be: 2 Send all of the documents that are relevant to your case to the court at the above address, also send them to the other side. Both parties must do this. These documents should be placed in date order and should be numbered in the bottom right hand corner. You should include the following documents if available: •       A copy of the contract/agreement •       Relevant correspondence, including text messages and emails  Photographs Before 4pm 08 July 2024 3 Send to the court and send to the other party your own witness statement and also witness statements from anyone who can give relevant evidence about your case. Both parties must do this. A witness statement must •       have the court case number at the top •       start with the witness’ name and address •       it must contain numbered paragraphs and should be typed and double spaced. If not typed, it must be written clearly in block capitals or printed. •       finish with the words “I believe the facts set out above to be true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth”, the date of the statement and the person’s signature. The original statement must be sent to the court and copies must be sent to the other side. Before 4pm 08 July 2024 I'm a little confused by para 7 in the order : Because this order has been made by a Legal Adviser without a hearing, you have the right to request that the decision of the Legal Adviser be reconsidered by a District Judge. Any request must be sent to the court to arrive by 4PM 12 June 2024. The request may be made in your online account, by email or on paper. The request must include an explanation of why the reconsideration is sought. Is this normal? Do I have to do anything with this by 12 June?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You was right Kimmy barclays filed their defence at the last minute as you said,it's now being transferred to another court would that be my local court or one of their choosing?

Hi all, I have been reading some other threads about joint accounts my account is joint but I have always signed any letters to barclay's is that ok or have I muffed up my claim?

Yes

 

CPR 19.6 says:

 

19.6 (1)Where more than one person has the same interest in a claim –

(a)the claim may be begun; or

(b)the court may order that the claim be continued,

 

by or against one or more of the persons who have the same interest as representatives of any other persons who have that interest.

you will be fine. i did the same with abbey and they sent a cheque in my name :grin: :grin: damn o/h got the post from postie. :wink:

 

you will be ok with barclays the end result is good and litigation are very polite and easy to deal with :grin:

Igot a notice of transfer of proceedings today it's being transfered to my local court Edmonton,on the transfer it says 1.The filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise.will I get a AQ from Edmonton then or will they not bother with it?

I have just received my court date today it's the 13th of august I didn't fill in an AQ I just paid the court the £100 fee,would now be a good time to ring Barclys to see if they would settle

Hi all,should I send off my court bundle to Barclay's first and then ring them to see if they would seetle or is it to soon to ring them as some other treads I have been reading say that they will not seetle until 2 weeks before the court date?

Can anyone help please? do I send a revised soc to include my court costs which is £350,it seems very quite on this site at the moment or is everyone out spending their reclaimed money.

No need to send a revised schedule of charges including the court costs.

 

Unfortunately I cannot give you any Woolwich specific advice as I am not familiar with them.

Quick update,I emailed Krysta @ Barclay's on friday no reply yet i offered to settle now i also said i didn't know who was handling my claim that is why i contacted her I'll wait until wednesday then I'll email her again.

Hi everyone,it's a long time since i posted any up dates to my claim I have been working away alot must keep paying the bills,I am about to sort out my court bundle I can't get a copy of the terms and conditions of my account I have been to the woolwich and barclay's they are saying as noone is opening any new accounts they don't have any.Will this matter as regards my bundle,also the court bundle template says to add some perssonal info not sure what to add can anyone help please?????

Thank's Micheal I'm getting barclay's to send me the t&c's and I will send them on to cag as soon as they arrive,will it matter to my court bundle if I don't have the woolwch t&c's because of the recent changeover to barclay's.When I asked about the date I opened my account with them they said it was 2000,but I have held an acciunt with them before they became a bank should I mention this in my bundle.

I think it's worth a one line mention and if you have requested Woolwich T&Cs and not had them provided, I think it's always useful to point out that despite your best efforts, Defendant has failed to furnish etc.

Thanks for words of wisdom welshcakes,Barclays sent me a copy of t&c's today titled woolwich & barclays are moving together t & c's I don't think they will the same as the woolwich's own t&c's that I signed way back when,should I use these in my court bundle?I will send these off to CAG tomorrow,also I can't download the OFT summary for my bundle it say's error not found any idea's anyone.

The T&Cs have undoubtedly been re-worded so I would cover yourself by including them as "CURRENT T&Cs in absence of original T&Cs". That way, any reference that B's makes to their T&Cs in support of their case is technically negated as they are referring to a document that was authored after the account had been opened.
