      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Afternoon all - homershairdo from the "Homershairdo versus HSBC" thread.

 

Started my claim against LTSB - have to say that I am a little concerned about this one due as LTSB seem to fight back!

 

Anywho, using the online banking service, I have been overcharged by about £500 over the past 4 years - so today I am looking to sent the letter asking ever so nicely (just like Mr Skull...!!) for my money back.

 

Unfortunately (well for me anyway) I am on honeymoon in three weeks, which means that my timetable may be slightly knackered - should I delay sending?

Unfortunately, you're on honeymoon? Well, I hope for your sake the future Mrs Homershairdo doesn't read this! :D

 

Don't delay. Even if you're a bit late in pursuing, it won't make any difference to them.

 

LTSB don't fight back, nor have any other banks so far. They make noise, and drag their feet, but in the end, they do not like the idea of having to explain their shady practices in front of a judge. Funny that.

I'm looking forward to it really - less than two weeks now so the nerves are kicking in!

 

I am sending the letter today, and from reading the various case studies, they will more likely than not come back with the standard "go forth and multiply" response. At this stage I would do the money claim route. When they make an offer, is there normally an "accept by" date or is it open ended?

Nope.

 

At this stage, if I've read your timeline correctly, you'd go down the LBA route, THEN the Moneyclaim route.

 

It's your claim, your deadlines.

If they make an offer and tell you they want an answer within x days, or they'll defend, (and x days is not convenient or enough time for you) my response (but then, I do NOT like being told what to do by people in the wrong) would be "go ahead and defend then". Don't ever forget: YOU are suing THEM, not the other way round!

 

PS: Go forth and multiply? You DO have the honeymoon on the brain, don't you... :D

I seem to have missed a stage - I was typing the ones this afternoon at work and was rushing a little!

Received an email from Mr Boden, thanking me for my email etc etc etc, and that it has been passed on to the manager of the complaints unit.

 

I look forward to receiving "sod of letter number one" in the next few days!!

Thank you for your e-mail dated xx May 2006 I am sorry to hear that you have not been happy with my response to date.

Unfortunately there is little I am able to add to my letter dated xx May 2006 as I have outlined the bank's position on the points you have raised, although I do respect you opinion about our charges.

This letter is the bank's final response, which means that if you remain dissatisfied you may refer your complaint to the Financial Ombudsman Service. If you decide to pursue your complaint through the Financial Ombudsman Service you must do so within 6 months from the date of this letter. I have attached a leaflet, which outlines how to contact them

Bump - just looking for a little help in terms of the reponse - various posts have various views in terms of whether to what 14 days from issue of LBA, or whether, once a "no further response" letter is received, and proceed with Moneyclaim. I also ask as my inital timeline conflicts with marriage and honeymoon!!

Morning! Now newly married and ready to continue my action before honeymoon!!

 

I have been through the FAQ's and the like a few times, so I am fairly sure of what I am letting myself into - HOWEVER....

 

I have corressponded with LTSB via email for the duration - in completing the moneyclaim form they require an address - I am correct in using the registered office address (25 Gresham Street) or is there another one??

 

Apologies for the daft question - but marriage has messed with my head!!:)

Welcome back Homer, hope it was a good honeymoon :)

 

As Elsinore says - your schedule, your timetable - your money. You may wish to drop Lloyds a note saying something along the lines of:

 

"Due to circumstances beyond my control I have been issue a claim via the small claims court for the unlawful penalties you have acquired from my person. I will henceforth be filing such a claim without any further notice."

 

At least then you have something to show the judge that you have kept the bank informed as to what's going to happen?

Just a quick question on the particulars of the claim, and interest.

 

5. Accordingly the Claimant claims:

a) the return of the amounts debited in respect of charges in the sum of £XXXX and any interest charged thereon;

 

in the £XXXX do you enter the amount including the 8% interest, or JUST the total of charges? I've had a butchers around the site but just looking to make sure before I send!
