Your on your way now. They will have 28 days from the date of service which will probably be latter on in this week. Some of the banks actually pay out quite quickly and others drag their feet and hold on as long as possible.

Carl,

If they do not acknowledge your claim or fail to submit a defence. Don't give them a minute longer than they need. Have a look at this; http://www.consumeractiongroup.co.uk/forum/other-institutions/62561-parkvale-g-e-money.html. It is absolutely uneconomical for them to defend the amount you are claiming. They will either settle quickly or default. As was my case,so press those buttons

Carl Stevens,

Another 14 days to enter defence. If no answer enter judgement.

It was actually 1/3/07 when the acknowledgement of the case and their intention to defend the case was made and on the letter from MCOL they say they have 28 days from date of service to file a defence does that mean that the 14 day rule from acknowledgement doesn't apply, help!

I tried that but it said it is 28 days from service of the claim that was on 24/2/07 so by 24/3/07 i shall be able to press the button

Dont be too quick to hit that Judgement button, the courts do not update the computer until 10am the following day. If you press the Judgement button, they could get ask for a stay. on the basis that they had dealt with it and the courts had not updated the records.... or something like that. My best advice is to wait 24 hours after the deadline and after 10am before you hit the button. Good luck with your claim, we are waiting to hear what you decide.

dsilverstein,

Quite correct. Another day won't do any harm. They can apply for a stay for any number of reasons after judgement. That is the risk you take, because the judiciary would rather a case was proceeded with than defaulted.
