      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I claimed on Friday.. On MCOL it says Issued 12/03/07 and that they have 14 days now to defend the claim. It also has another section which I am unsure of - Start is written under Judgement section... Do I use that section after 14 days??

i'm not sure what you mean scotlady? they have 14 days to state if they are going to defend, which in my case they did, they now have 28 days to respond, you will see it change to acknowledged, thats where mine is at just now, have a read of my thread, deller explained it to me, hope this makes it clearer.x

:( Not heard anything as yet so called the court to ask where I stand. They have until the 16th to file their defence..

 

If I aint had payment or heard anything I call the court on 17th and they go from there..:cool:

 

Next MCOL is getting done on Friday for joint account too:)

Hmm..

 

The account I am claiming for has been sitting overdrawn since Jan..

 

But - NO charges have been applied since then. Normally I would get one for being overdrawn in Jan, Feb & March but its the same amount still:confused:

Well I called the court and the 28 days are up today.. I am gonna hang on till 2moro to continue. Although it would kinda come in handy if they paid up before Friday as my other half is off to Canada to take up a new job:eek:

 

I am however getting kinda worried.

 

Has anyone NOT been reimbursed??

I've just sent off 2nd letter to ask for charges back, recorded delivery today.

 

I opened a parachute account but they have messed it up! HSBC opened the account amonth ago but despite 8 phone calls, 3 emails... all of which have been ignored - two trips to branches and they have finally ordered a cash card and the other stuff I need... I've only ever got a letter from them! I might have to look elsewhere as this is not a good sign.

 

good luck all. I'll add more info when I get it. (I'm also claiming from Monument as I have a nightmare 3 years with them and only ever missed one payment which I paid the charge instantly but yet the've added £500 to my account for no other reason!

I am seriously losing faith in getting any charges back. I cant pay for my next MCOL until this one is finished and time is running out:(

 

I really wanna press the judgement button but I wanna give them a chance.. am I too nice?:???:

Scotlady, i wouldnt get to worried about it, when my deadline came very close i sent Mr Bacon a very polite email (truly a genuine polite one no sarcasm) and explained in my email to him that the deadline was coming closer and witin a couple of hours he paid out in full.. I also know he got my email as i requested a reciept for it. Try emailing him, mine was answered about 6.45pm so he obviously works late...

I've only just got to the 2nd letter stage with Nationwide... but good to know the stages. Hopefully you will get the rest over the next couple of days... other posts for different banks have done this... small amount then large a few days later so... fingers crossed.

 

I have just entered court proceedings for a Credit Card company. :eek:

I've just got my letter from Nationwide stating that I should look at my T&Cs.. and that I could have got an Overdraft... actually I couldn't as I only had a basic account and told I wasn't allowed!!!???

They are also 'sorry that we can't agree to your charges being refunded'.

guess that means I get to send them a LBA letter. :p

 

its says to contact them back if I'm not happy and wish to continue this action. the letter has no name on it... just signed with the letter 'A'. customer service manager. Branch service centre, member account servicing.

and the address is a PO address!!!

 

From looking at this post I'll send the LBA to the Electra House address.

 

I've got the claim form back for my fight with Monument also!!! scaring as it says they are defending all of the claim. never done this sort of thing before and I'm feeling rather cowardly custard like :eek:

 

I keep forgetting myclaim login details! dammit :-D

Hiya sry for not being around. I ended up in hospital that day lol. No it wasnt shock:o Anyway I apologise my other half spent the 1st lot of charges refunded but claiming the 2nd lot to which I WILL make a contribution as he's in Canada now:p

 

Anyway I got paperword showing defence this morning for the 2nd account and its showing Eversheds as being the defendant now.. Does this mean its getting tougher to claim now??
