      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Urgent Help Needed:eek:

 

Dear All

 

I was wondering if anyone could give me some advice. I'm trying to claim back charges from Natwest as I did successfully from Halifax. I've got as far as issuing the court stuff, and they had until yesterday to enter a defence. All was looking good, but now the buggers have entered a defence at the last minute. What do I do now? I would be really greatful for any suggestions:)

ok - I've now written the letter back to Cobbetts telling them that I don't have to provide any further information, and I've now received the questionnaire from the court. I'm going to complete it and pay my £100 (due because the claim is over £1500).

 

I was just wondering if anyone else has got this far and actually gone to court? What is likely to happen? I presume that I will win, but what a load of hassle. I went after Halifax for £3300 and got it back by just sending the court stuff.

 

Any feedback would be most welcome:)

Just thought I'd post a little update, and ask for some more suggestions

 

I've had another letter from Cobbetts after sending them a letter telling them that I didn't have to give them anymore info, saying that Natwest are willing to up their offer to me to £850. Their letter also says that I have basically no chance in winning if we actually go to court. I'm thinking if that is the case, why are they offering me more money? Has anybody else had the same?

 

I would be grateful if any of you could give me your opinions/advice. I've had a quick look at the other postings, and I can't see anyone else that has this problem.

I have paid my £100 to complete the court questionnaire, and I have been sent a copy of the questionnaire that Natwest completed - They did not pay thier £100 and said that they had requested information that I had not provided. I pressujme they mean the CR18 (or whatever it's called). At the time they requested that info, I sent the template letter back stating that as it was going to be dealt with in the small claims court I didn't need to give them anything else.

I have since had a letter from the court saying that my claim has been deferred until April.

IS THIS SUPPOSED TO HAPPEN? I'm getting a tad worried

I've just spoken to Southend County Court, and NW have paid the fee for their questionnaire!! It is the judge who has requested that the claim is stayed until the 5th April. - IS THIS NORMAL?:eek:

 

Ok you can ask for the stay to be removed you need to write to the court. I would try firstly contacting Cobbets and informing them you are going to ask for the stay to be removed, they may offer you a settlement.

***UPDATE***

 

I've finally won!!!! Yesterday, I arrived home from work to find a cheque for £1907. The full amount I asked for. I had to take them all the way to court, and my court date was scheduled for the end of June. I thought I was going to have to wait until then. A word of advice to all you unsure people - Keep going with it! I was starting to doubt it was going to work but I did it

:)

 

PS. I also won £3300 back from the Halifax - they were a hell of a lot easier to go against - They paid out on the 2nd letter
