      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I think you need Microsoft Works or Microsoft Office on your computer to download the spreadsheets.

 

Your claim does'nt seem too large, so the following may not take too long. You can add the 8% interest column on the end of the schedule that you've already made up, and work out for each charge from the date it was taken from your account by multiplying the amount of days by 7p right up until the day you put your claim in. Do this for each charge, then at the bottom of that column add them all up to give you the total.

Help!!!

 

I am claiming 655.00, I have had £340 as a refund & am still owed £315.

 

Just filling in the spreadsheet to calculate the interest. How do I know which charges to put on that?

all of them basically regardless of whether the have been paid or not, just deduct the balance at the end

I hope I have done it right, I have 2 accounts to submit court action on...this is the 1st!

14 days to acknowledge...if they do they then have an additional 14 days to submit a defence...however the 14 days is from the date deemed served which is usually 5 days after you submitted it...so technically they start with 19 days

Help needed!!!!!!!!!!!

 

I sent the letter refusing the part settlement & they have ignored it.

 

I am now filling in the moneyclaim online!

Do I use Abbey National PLC as the organisation & the address I have been sending letters to?

Hi Glittery girl, I just wondered if you had any success with your claim. Sorry if its posted somewhere else on the forum but i am new and have been reading up for ages so my eyes are a bit square now ;-)

OK filed on the 19th...5 days until date deemed served = 24th. 14 days to acknowledge = 8th May..once acknowledged they get a further 14 days to submit a defence so that must be by 22nd May. What will probably happen is that they will submit a defence at some stage and then your claim will be transferred to a local or Mercantile court. Lots of waiting around so just sit back and wait for the courts to write to you and let you know whats next. You never know you may be lucky and the judge may even strike out their defence as is happening in a few cases now.

you wait for the courts to write. they will transfer it to a court near you and give you further instructions. theres a lot of waiting in this game

Help!

My court bundle is due in tomorrow :-(

 

I am claiming about £370 from Abbey for charges & have just realised that my court bundle is due in tomorrow :o I have had 2 sick children for the last couple of months & I really have put it to the back of my mind.

 

What shall I do?

 

Is there any point in contacting Abbey and asking for them to settle out of court?

I have a email address for a Inga Kirkman from Ashurst but they have not written to me so how do I know they will be handling the case? :confused:

 

Have I messed it all up?
