    • If you have not kept the original PCN you can always send an SAR to Excel and they have to send you all the info they have on you within a month. failure to do so can lead to you being able to sue them for their failure.......................................nice irony.
    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................
    • Hi,   I am not sure if I posted this already here but I don't think I did. I attach a judgement that raises very interesting points IMO. Essentially EVRi did their usual non attendance that we normally see, however the judge (for the first time I've seen in these threads) dismissed the notice and awarded me judgement by default because their notice misses the "confirmation of compliance" paragraph. in and out in 3 minutes (aside from the chat at the end with the judge about his problems with evri) Redacted - evri CPR loss.pdf
    • Just to update this. I did apply to strikeout and they did not attend the hearing. I won by defualt and the hearing lasted 5 minutes (court only allocated 15). The judge simply explained that the only matter he was really considering is if the Defendant could have any oral evidence to defend the claim. However he said he had decided that based on their defence, and their misunderstanding of law, and their non attendence he did not think they had any reasonsable chance so he awarded me SJ + Costs on the claim form + the strikeout fee. Luckily when I sent the defendant the order I woke up the next day to a wire trasnfer for the full sum of the judgement
    • Hello, I am wondering if someone can advise. I sold some goods via an online platform who essentially middelmans and authenticates luxury goods.  I have sold over 100 times with them in the past without issue but a while ago I had a sale go wrong, whereby they claim they never received the shoes in the parcel and instead received empty boxes. They wont show any photos of what they received. I considered whether to pursue them or the courier, and decided to pursue them because the UPS tracking indicates no issues at all, but also because they are the ones that contracted with UPS.  I sent them a PAPLOC which they claim was "lengthy and pre written" which is true because I simply adapted a previous one. They rejected any resolution so I issued a claim using an adapated thread from this forum from before against i believe evri. Anyway they filed a defence which essentially says that they think I shipped empty boxes and never shipped the shoes and am commiting fraud. However, I have weight records of every parcel I ship (and have done since 2019) and they have provided no evidence to support their claims. They also failed to comply with CPR request for inspection of certain documents within their defence, such as a report by their authenticator who they claim emptied the box (Although I know this is false because they have had literal job offers for "Warehouse staff" with the job description of opening and sorting incoming orders (OWTTE) so I also think here that I have a ground that they are trying to mislead the court, which once again is likely to obstruct the just disposal of proceedings. The amount is just over £1,000 I'm now wondering whether I should apply to strike out their defence / apply for SJ on the grounds that the defence is totally without merit and will obstruct the just disposal of proceedings by making me wait months for a trial that they are bound to lose and upon them having absolutely no proof to support their claims, and me having weight records, as well as the fact they failed to comply. I am aware the fee for this would be £303 but the trial fee would be £123 itself so the difference is £180. Any advice please?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hiya all, I have got very excited about this site and sent off dpa letters yesterday. We have been charged in the realms of about £4000 over the last 6 years.... We could really do with this money now, as in so much debt still. Just one question because I have read loads and loads of threads and cant find anything. My partner is a bit worried now because we have our mortgage with the Halifax, is it possible anything could happen there? Might sound stupid I know, just want to put our minds at rest. :eek:

I have sent off my dpa letters to Halifax 3 days ago, looking forward to getting my statements now, lol

We have remembered that about 3 years ago we also had an account with a&l bank, we shut it because the charges were going beyond a joke, :mad: we took a loan out and paid it all off, then shut it, Problem now is we have no correspondence at all as to our account number, can we just ring and ask for our old account number? Can we send off a dpa without an account number? Really not sure what do do, dont want to ring them in case they guess what we're up to, sad I know!!!!

If you write the DPA, giving info of your name, d-o-b and address (especially if that has changed since) then the most they can ask for is evidence of your identity.

 

This should be all you need to get the info you want.

 

Perhaps you could pre-empt the request for ID and include a copy of your D-Licence or Passport...

..

Hiya, I sent my dpa to halifax last week but have now found my statements long story!!!! Do I have to wait for the 40 days to expire b4 sending my prem letter, or can I just send it now that I've got my statements anyway? :confused:

The 40 days was just a time frame set out by the DPA for them to comply with your request for information.

Hello, can someone help with this please? I am preparing my premlinary letter today. I have got all the charges etc, What I need to know is, I have charges coming out at the end of the month, can I put those in the letter as well? Or do I have to start again when I have done this claim up to todays date?

Help please......... I have been looking for something similar in the forums for about 3 hours now and cant find anything, so sorry if I have missed it and repeating myself.

I think you will only be able to ask for charges that have actually taken place at the time of your request going in not for ones that you have not received yet.

 

However, when you then send LBA you can quote a new figure for the extra charges.Maybe if you include "and for any further charges that i may occur as a result....." with your prelim letter.

 

A final figure can then be put forward on any court claim that you may take.

Hello all. Just an update for you. Sent off our prelimanary letter for the 2nd account with Halifax, waiting with baited breathe now, lol:rolleyes: Still waiting for statements to arrive for the biggie account, I hope they have taken loads off us, our guess its prob in the region of £3000, looking forward to getting that back, I can tell you.

My son and daughter are also in on the 'get our money back' they havent got much, probably about £100 each but they are both going on a boys, girly holiday in the summer and it would help towards their beer and kebabs, :p

Hello all, Had our statements through yesterday, 28 envelopes, lol. The postman is my cousin, not pleased, lol. When I told him what we were doing he said he's never had charges, he's a good boy. Anyway the charges and interest came to a grand total of £2710.52, my god I spent it in my head already, haha.

Along with my other charges of £1077 (sent off prem letter 10th May) on our other bank account, I cant wait. I was expecting more charges on the 1st account and was quite disappointed it only came to that amount, sad I know. My son and daughter and Mum are all doing theirs now as well, sent off their DPA's. Not much about £100 each on my sons and daughters but they are both going on holiday (not together, with their mates) so thats more alcohol they can have!!!! Still waiting for statements off A & L, more money to spend;) Will keep you posted.

Hiya all, Just an update, the 14 days deadline is up for the prelimenary letter to Halifax. Haven't heard a sausage from them. Just typed and signed and put in an envelope ready to go my letter before action. Probably wont hear a dickie bird from that letter either... I'll let you know in 14 days or sooner if I hear any thing, hopefully.:rolleyes:

Don't worry - they didn't respond to my Prelim. Got 2 offers after LBA, but they will 'regret' not paying up tomorrow when they are served with my court papers.

 

Holding out will now set them back a further £830.

 

Stick with it - and don't accept less than EVERYTHING

I've read loads of threads and wasn't really surprised that I havent heard any thing. We are holding out for ALL the money, no half measures. We haven't worked out yet how much extra on the 8% if we have to file a claim. Another week and the other LBA goes off, coz we haven't heard off that one either!!!! Never mind more in the bank for us. Since I sent off my 1st prelim letter, I have had another £198 charges which we have added onto the LBA letter.

Hiys everybody, I recieved a letter from Halifax this morning offering £180 as a full and final payment....... I am claiming over £1000 so I think you already know the letter I sent back to them, I'll hold on for the next offer now, and refuse that as f&f payment as well. I'll let you know of any more developements, hope all your claims are going well..:D

Hiya Everyone, I haven't been on here for a while, long story. Anyway my mcol is showing as acknowledged on the 14.6.06. I received a reply from halifax claiming they will be defending in full, yikes!!! but reading the threads I'm not really worried coz some of your cases filed at the same time have been paid in full already. I'm ready to go to court been reading and reading and reading just in case, but I'd rather not go, lol. We are having some money troubles at the mo, like most of us on here, I hope they pay before the end of June coz haven't got the mortgage money this month!!!! I've been laid off from work about a month ago and struggling to get any decent work at the moment, just temping.... Our car is going to be repossed and my OH is a taxi driver so he won't have any work either, just gets better.. Thank god hes got an HGV licence as well so he can pick up some work at least. My daughter has got us a cheap car on hp just to get him back and forth to work, coz we couldn't get one on credit and didn't have cash to buy a car. Surely it should be the other way around and us buying her a car!!!! something wrong there..... Hopefully this money will come through quickly then we can file our other mcol for £3000 and set our selves straight and never be in this position again, god its so worrying. I know there are plenty like us and some in even worse situations. Well I'll let u know when I get the refund, then I can relax a bit.

HIYA, Thanks for the replies, we first got into this mess coz of csa (dont start me on that) and court and solicitor fees for OH to see his daughter. We just kept paying courts and solicitors and let other things slide coz daughter was our priority, OH took up taxi driving to avoid the incredible attachment to earnings they made when he was a lorry driver. Not saying that he shouldn't pay but they left us with £180 a week to keep a family of 5 !!!! I was on materity leave so had basic wages...anyway enough of my moaning, lol things are finally looking up and yes I keep checking online to see if Halifax have put money in, driving myself mad now coz doing it bout 5-6 times a day, lol.

Thanks for the encouragement, if it wasnt for this site we'd be knackered. Really good to see so many others getting their money back, well done. Mine will soon be reading SETTLED IN FULL.......

LBA Sent 6th June

MCOL filed 22.6.06

Prem letter for £1077.15 sent 9.5.06

Offer of £180 as f&f, have refused

Money received in account 28.6.06

 

A & L DPA sent 5.5.06
