      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You don't need summary cause, as it's a Scottish thing. You're far better to do small claims in England, using their English head office address, or whichever address they've been writing to you from. You won't be able to use the moneyclaim website because you're in Scotland, so instead you'll need to download the N! claim form and use that. It is very simple to complete.

thanks barty,see if i use the London reg office will i have to send my claim to a court in london,http://www.hmcourts-service.gov.uk/HMCSCourtFinder/Search.do

when the bank looks at my address they will see its in Edinburgh,Scotland,iam thinking they will defend the case,knowing its to far to travel...what do you think ?. thanks.

Hi. Don't think the banks will be too bothered about where you live, they just seem to want to avoid going to court. so it's unlikely you'll have to go further than the post box.

 

As they have branches all over I think you can file in any town they have a bank.

 

I used the head office (london) address on my claim but filed my claim with the court in wakefield. (my home town). The london address is just the place the court gets in touch with the bank.

hi all,do you think i should use our complaints procedure and how to complain for my claim,i dont fancy going down to england,cause ive read if they defend the claim i will have to go down to a english court.

 

ps.if i try a summery case,and i lose how much under a summery will i have to pay the bank in court costs.thanks

I know nothing of summary clause or Scottish procedure, but what I can say is that, unfortunately, Lloyds internal complaints procedure will get you absolutely nowhere. It is genuinely quite sad actually, but the banks (Lloyds especially!) really could'nt care less about resolving your - or any other - complaint, and they just will not listen to any sort of reason or rational arguement. They will instead delay for as long as the Banking Code's terms allow them to (8 weeks), and then fob you off with the usual nonsence along the lines of - "service charge, in accordance with T&C's, your own bloomin fault anyway.... blah, blah, blah....."

 

Sad, but true.:rolleyes:

 

The Ombudsman may be an option, but please bare in mind that Lloyds have not defended a single claim in court yet (of hundreds!), and there is certainly no indication that they intend to start now. There is a very good reason for this - they are far more worried about court than you are.:wink:

hi all,I went up to the court today to ask about a small/summery claim,the guy tolled me that if i make a small claim and i lose it will cost me £75 and if i make a summery claim (cause its over £750)and i lose the cost is unlimited,so say i lost the cost of there lawyer,paper work,etc etc:eek:

If you can't sue through the English courts then your best bet will be the Ombudsman then.

 

Sorry, I thought you linked Lloyds complaints procedure above, hence my comments. That'll teach me to pass comment without checking first!

hi all,i got this letter on saturday,i thought it was a bit weird? because i thought i would not hear back from the bank after my LBA, till i took them to court...what do you think?
