      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Congratulations for posting in the correct forum, here you will have other “experts” (I see one has already found you)who know how that particular this bank reacts.

 

I have just finished my claim with this bank, but I decided to stick around to see if I help others like you who are just starting out with their claim to see if I can share anything to make your journey through this claim a bit better!!!

Remember the banks have acted unlawful you haven’t!!!

 

Well done for reading the FAQs and continue to read as many threads as possible as there is a wealth of information on here!!

 

Remember its important to open a parachute account, especially if the charges are spiralling out of control and you have little or no money left, at the end of each month.

 

If your account goes into a negative balance after you have transferred your banking, send them this notice to prevent them taking any further action.

Also look for another newbie claiming against the same bank as you, that way you can do your claim together and support each other as the post drops through the door!!

 

Sometimes the banks act awfully and you can get very stressed out by it all. But stick to your guns - you are in the right - they are not. Don’t let them put you off, that’s what they want to do!

Thanks Allyxia. Luckily these accounts are pretty much dead. Nothing in and nothing out.

 

We keep 5p or so in each to cost the bank. HA. :p

 

My NatWest account is already closed, and my charges are only for £68 so I'm hoping they give in quickly. It's a lot of money to me as a student!

14 straight days on Prelim then 14 straight days on LBA and then it is suing time. And you need to have at least 100 words I think to have the signature showing.

Got the statements today.

 

Just checking interest can't be claimed unless it's alongside a charge right?

 

Gold account - in 2001 - cost £6 a month and then 14.99% ARRANGED over draft :eek:

Gemz- I am still trying to decipher this for you, can you tell me what the charges bit at the end of October/November 2002 say and i will tell you the answer. OK?

It says for the 31st January 2003 (early ones are Advantage Gold charges I think)

 

Charges "03Jan A/C (account number)" and the charge is £6.00

 

It's the same every month from then on.

just to let you know as its a small claim i claimed for y cousin and the claim was for 400 which is still not big and they paid out after the lba it never went to court

Hi there Gemz I have some other information for you regarding Advantage Gold charges. There is a sticky which I took this from.

 

As from Oct 2002 The Advantage Gold fee was £6.

From Sept 2003 The Advantage Gold fee was £9.

From July 2005 The Advantage Gold fee was £10.

Finally from June 2006 The Advantage Gold fee was £12.

 

Nat West put charges for Advantage Gold and Unarranged Borrowing together from 31/10/02 so that the amount would appear as one and not too separate figures.

 

This should help distinguish between penalty fees for Unarranged Borrowing which you can claim and Advantage Gold fee which you cannot claim.

just to mention as well my boyfriend as just had a payout of 1600 and i did not know about the account fees at the time of sending the letters so put all charges on and they have paid out all of them
