    • Northmonk forget what I said about your Notice to Hirer being the best I have seen . Though it  still may be  it is not good enough to comply with PoFA. Before looking at the NTH, we can look at the original Notice to Keeper. That is not compliant. First the period of parking as sated on their PCN is not actually the period of parking but a misstatement  since it is only the arrival and departure times of your vehicle. The parking period  is exactly that -ie the time youwere actually parked in a parking spot.  If you have to drive around to find a place to park the act of driving means that you couldn't have been parked at the same time. Likewise when you left the parking place and drove to the exit that could not be describes as parking either. So the first fail is  failing to specify the parking period. Section9 [2][a] In S9[2][f] the Act states  (ii)the creditor does not know both the name of the driver and a current address for service for the driver, the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid; Your PCN fails to mention the words in parentheses despite Section 9 [2]starting by saying "The notice must—..." As the Notice to Keeper fails to comply with the Act,  it follows that the Notice to Hirer cannot be pursued as they couldn't get the NTH compliant. Even if the the NTH was adjudged  as not  being affected by the non compliance of the NTK, the Notice to Hirer is itself not compliant with the Act. Once again the PCN fails to get the parking period correct. That alone is enough to have the claim dismissed as the PCN fails to comply with PoFA. Second S14 [5] states " (5)The notice to Hirer must— (a)inform the hirer that by virtue of this paragraph any unpaid parking charges (being parking charges specified in the notice to keeper) may be recovered from the hirer; ON their NTH , NPE claim "The driver of the above vehicle is liable ........" when the driver is not liable at all, only the hirer is liable. The driver and the hirer may be different people, but with a NTH, only the hirer is liable so to demand the driver pay the charge  fails to comply with PoFA and so the NPE claim must fail. I seem to remember that you have confirmed you received a copy of the original PCN sent to  the Hire company plus copies of the contract you have with the Hire company and the agreement that you are responsible for breaches of the Law etc. If not then you can add those fails too.

    • I understand what you mean. But consider that part of the problem, and the frustration of those trying to help, is the way that questions are asked without context and without straight facts. A lot of effort was wasted discussing as a consumer issue before it was mentioned that the property was BTL. I don't think we have your history with this property. Were you the freehold owner prior to this split? Did you buy the leasehold of one half? From a family member? How was that funded (earlier loan?). How long ago was it split? Have either of the leasehold halves changed hands since? I'm wondering if the split and the leashold/freehold arrangements were set up in a way that was OK when everyone was everyone was connected. But a way that makes the leasehold virtually unsaleable to an unrelated party.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all, time for my new thread and I want to start it off with a quick question since the Halifax are dragging their heels at the min. I am basically going to start claiming on an account that was closed last year. trouble is I dont have any details for that account and so I am waiting on the Halifax to get back to me. I am wondering though if I can still send my S.A.R - (Subject Access Request) without the account number. Do you think this can be done? or do I need to wait? Or maybe one of you has a contact number for someone who can help me get this info.

Hi mate,

 

I had the same situation with Barclays and eventually managed to get a list of charges from them anyway, though it was an uphill struggle.

 

Write to them using the usual template, and list all your previous addresses, your date of birth, etc.

 

Being able to cross-reference names and addresses with account numbers is a basic function of any database. They'll use any excuse not to give you the information, but keep at them and you'll get it eventually (it took me three letters).

I'd initially try going into a branch to see if they can locate the account number - if not, send them the SAR anyway with a list of all the addresses you had while you held that account.

Had been into branch a couple of weeks back and was still waiting, but had a brainwave bout half hour ago and found a really old card with the details I need so my SAR will be on its way Monday.

First response to my S.A.R arrived today and ts a bit different to my first claim against the Halifax. They just said they have recieved my request and as they have 40 days to comply, I will recieve statements no later than the 7th of Feb 2007. The letter from them was dated 27th Dec. Now I'm no maths whizz but I make that 42 days !!!!!!!!

Lets see what happens. Also got similar letter through from Mint so am just waiting for the Lloyds TSB and Capital one Letters now.

Oh yes, I'm on a mission now.

Well I got a letter about 3 weeks ago telling me I would recieve my statements within 10 working days. That came and went so I rung them and was told they would be here by the 5th feb ( which is the 40 day mark ) and lo and behold still no sign by the 7th I just rang them and was told they should have been sent on the 13th of Jan and they will have to reorder them. Now about to email their legal dept and inform them I will be filing with the court on Friday if statements have not been recieved by then.

Spent yesterday on the phone to and emailing Rachel hinchcliffe over at Halifax Legal Dept and havent really got anywhere. She says she has contacted relevant dept and reordered but cant give me an indication of the timescale. I have warned her that I will take legal action if necessary as well as filing a complaint with the information commisioner.

So today I sent them letter informing them they have failed to comply with Data protection Act and will file with the county courts in 7 days if I am not in reciept of my statements.

Statements arrived today via business post, special delivery, followed by a phone call from them asking if I recieved them.

so here goes, was not expectng too much from this account as it was closed 18 months ago and I knew it was in the red when they closed it. statements show it was only £107 in red and couldnt believe that my charges amount to £2611. was expecting £800 - £1000 tops. So sending off Prelim first thing in the morning and will wait for the first offer. Am wondering what exactly they wil do as I already claimed over £3000 from my other halifax account in december so maybe they will pay up pretty quickly seeing as the know I am prepared to go the distance.

Hi Tezviper and congratulations,could you please send me Rachel Hinchcliffs email address as i have already tried emailing her but keep getting returned saying cant find so i obviously have the wrong address.I have been waiting 3 weeks for a letter of acceptance they said would be getting sent out next day that was the 23rd jan still not received it.Thanks in advance.

Well I posted prelim last thursday via recorded delivery and as of yet its not been delivered. I just had to resend my LBA to Lloyds yesterday as I posted that 13 days ago and when I decided to just check when was delivered it showed as not been delivered. Will wait tiul tomorrow before resending my Prelim to Halifax.

No further response from my prelim so LBA going tomorrow. I am expecting payment in full before I file for court on this one but I wont mind if the dont as It adds £800 to my claim.

Oh yea I forgot to mention that I was about to resend my prelim as Royal Mails website was showing as Not delivered. until I got a response from the prelim that is. Even now the system shows that it hasnt been delivered. Makes you wonder why we pay for recorded delivery when they often dont get signed for.

Cant believe it, Was just checking through my LBA that I sent 7 days ago and I made a mistake on it. I put the wrong account number on it!!!!!!

Try using the phone number on the Royal Mail receipt. The web site didn't recognise my reference number today, but when I phoned (they use voice recognition) I found that the letter had been delivered the day after I posted it.

Halifax called me today to make an offer of £1600, as the claim is for £2600 I flatly turned it down and explained that I had already succesfully claimed over 3k from them in dec and I would require full amount or it was off to court next friday.

He said he would call me back in 10 mins after speaking to his manager......

 

Phoned back like he said and offered full amount.

 

I guess that means

Acceptance form arrived pretty promptly along with the covering letter advising me that if I contest any future charges they may close my account...........
