      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

don't worry.

I'm sure Johnsons government is moving heaven and earth ... to get the £3,500 Mp's energy expenses allowance increased

.. as everyone knows you simply cant heat 3 large houses on that now without it threatening cutting into your MP's salary .. or political donations from the energy companies ..  or your 'advisory role' payments for companies you 'advise' your gov pals to use ..

 

especially as dropping the extra costs into your shell companies expenses and tax breaks are hitting the limits of even populist boundaries given the threats of investigations ..

... Mind you - it all averages out about right give or take a few degrees or a few million gallons of water over the whole world and over an eon or 2 eh climate science deniers

and the water and power companies are making record profits with record payments to senior staff - so they must be doing well ...

Yep, as:

Despite the flood/drought boom/bust now well established and largely (as) predicted

 

* We had floods, with water companies literally adding lakes of doodoo to the overflowing rivers while paying their bosses massive bonuses for a job ell done ..

 

* Now 10 minutes later and a 'bit of warm weather' as the climate science deniers claim - and we are battering down the doors of a drought

 

* So how are they adding to that failure? - not just a hosepipe ban, but also banning farmers from watering their crops

- well they might as let them die as there's nobody to pick them anyway eh?

 

- Ready for the food shortages caused by that knock on effect?

* Yep - by breaking our agreements and international law and generating a trade war with a massive trade block just next door

 

Incompetent twats careering from one entirely predictable disaster to the next.

Can anybody explain to me (other than rampant profiteering) why

 

Given the UK guv was claiming only something like 4% of British gas comes from russia and gloating about how the EU had so much more exposure to Russian gas :

 

... why are our prices going through the roof - literally multiplying, FAR higher than the EU is allowing their companies, when we apparently have

 

* so little 'exposure to Russian manipulation

* export to other countries (at top dollar)

* and 'our/british energy companies are making record profits at our expense from the nations resources

 

???

Sounds like the working from home economy is at risk as well, if the Internet goes down for extended periods, as the data centres have no power or restrictions placed on them. 

 

Hopefully the power will stay flowing, but the modern world we live in is all about technology that uses a lot of electric. 

 

 

Never mind internet and  power .. What about water/sewage ?

 

* They are already pouring literally millions of liters of poo into the waterways every year because the sewage infrastructure cant cope  - and rewarding themselves and shareholders handsomely for doing that with Billions under spent on even existing infrastructure used to pay massive bonuses and unwarranted dividends

 

* Reservoirs are already struggling .. wait until just 2 years from now to likely see some boom/bust flood/drought that will make this year seem a breeze

As they are already making record profits with the 'target' increases already, where is there ANY justification to raise it further?

Thing is, I do largely agree with Starmer that water should not be renationalised at this stage ....

 

They had huge debts wiped out by thatcherite policy when they were privatised

They immediately started running the companies into MASSIVE debt again to pay massively increased senior staff pay increases and huge dividends - not to invest in infrastructure

 

They are now just worthless debt mountains which the taxpayer would have to bail out - AGAIN, let alone all the pension schemes with large share holdings if renationalised.

 

 

So

FOR STARTERS - Legislate that no more than say 5% of actual investment level can be paid as dividends ...

.. and zero bonus to directors if the company fails to meet investment, debt reduction and environmental requirements (with associated huge fines and cleanup costs).

The big issue with not paying is that you are hitting the 'resellers like Octopus not the profiteers

 

The energy giants profiteering needs to be dealt with severely by governments

Given the effects the profiteering is having on economies, I would seriously consider treating it on the basis of an act of war.

Sounds severe and extreme - but so is the situation

Not just consumer bills, businesses economies are going bust while they rake in massive profits

I've been out of power systems for a decade now but try to 'keep in touch'

Just curbing the rampant profiteering by the large energy companies would be a start

 

The profits they are making in just the last 3 months are obscene, and they are shunting around 50% of it (billions and billions) straight back to shareholders in buy backs and dividends.

 

Capitalism gone amok

 

'Governments directly subsidising the high cost'  as you suggest is just shunting taxpayer money into energy company obscene profits, although its a slight improvement as its at least those who earn enough to pay tax that would be hit more - bit of course not the wealthiest, who report sod all taxable earnings in the UK.

 

Its the profiteering that needs to be curbed. and it needs to be done 3 months ago.
