Just got an allocation questionnaire from the county court (cost £100). MBNA have decided to defend my claim against them for non-compliance with the Data Protection Act on the grounds that the wording of the text in my letter didn't say it was a request for all statements over the last 6 years (I used the standard text posted on this site, and other banks have complied with it). Their stand is ingenuous to say the least, - they returned my £10 cheque but kept the ID and utility bill I'd sent as proof of ID with the initial letter, then told me to put in another subject access request under the Data Protection Act. They seem to be trying to up the stakes.

 

What should I include in Section H 'Other Information' . I was going to attach just the crucial correspondence, although I have been told that this itself is not neccessary. I also want to call Steve Bailey and another staff member as witnesses to cross examine them on what they said to me on the phone.
