    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

40 days then to take a tour around the forum, read all the threads you can and get familiar with the process. you can get your statements through online banking although sending off for your S.A.R. request in my mind gives you plenty of time to observe what's going on - and what's likely to!!

i'd think you put the date you filed the mcol.

 

did you ever look at the 149, netty? it is so much easier.

hope you get it into the small claims - you didn't say - but was the figure without court interest and fees below 5k? i put earlier - that would be your justification for asking for small claims.

 

did you see trevor mcdonald last night? it was another martyn lewis reclaiming charges story. he kept referring to the last one - which is the one i saw and they referred to cag and that's when i joined and started my son's claim - he said over 1 million template letters have been downloaded - hard to believe - but i guess it's just going to get bigger and bigger - i'm glad his is over and done with (unless he goes for the interest on the managed loan). hsbd/dg will surely buckle under the weight of more claims. i see from what some of the threads are saying the claims now apparently get sent from dg to a "new claims review office", so i think they are finally getting organized although i think this new bit seems to put the claims back a couple of weeks - hopefully you are right on the edge (don't jump) of an offer, but it's new territory - i still think you'll see an offer either just before or just after the aq goes in.

hi lats

i didn't look at the 149 because my initial claim without anything else is already 5050. with interest and no court costs, i'm claiming for 6187.49!!

that figure is when i put the date that the claim was served, so if i change that to a couple of days before, when i filed it, it will come to a little bit more!

i've still put on the 150 that i want it to go on small claims track - if the judge doesn't allow that - then i start panicking (and saving/borrowing).

well, i'd put that sentence in there somewhere - that without court interest and court fees - the initial claim is for £5050 (it says in everything i've read that slightly over - they will put it in small claims and that's only barely slightly over - so use it) i do think date of the claim is date filed though. it will be fine - it will be long over before the court date!

 

i see now - you are asking about the date for the s/s - i'd leave it as you sent it to dg.

thank you lats, i was hoping i could write that in somewhere. i can actually write it in twice where the small claims track is mentioned on the form - phew!! i hope i get a sympathetic judge who's claiming himself!! lol (there's a thought).

Right!!! done it all this time - hopefully correctly, i've been over it so many times now there can't possibly be anything wrong with it!!

 

N150 filled in, with the added line - "My claim, before interest is applied, is blah blah".. This issue...... etc". That just takes it a tiny weeny tad over the 5K mark so - fingers crossed eh! New spreadsheets done and printed (I knocked off one charge as it was for Dec 00) decided that i'll take it off before they do, and start blubbering about SOL's, Draft Order of Directions attached - and away we go (aaaghh)!! 4 x copies - one for court, 1 for dg, 1 for me and 1 for court bundle should i need one.

i was just having a look at the court bundle (which we won't need) and the other documents which you would include and it's probably well over 60 pages (40 for the bundle alone) and it's to be done in triplicate - better get a new ink cartridge in or do it at school when no one is looking! you'll get your money before that!!!!!!!!

well... after emailing debs and cc copies to all other available email addresses and then repeating for each (god how painful am i lol) i finally got a phonecall from somebody 'dabidor' at dg today. they said that they were also due to file their aq and that actually a letter was being prepared by rachel as we spoke. so this letter is due to arrive on my doormat on friday morning with a settlement offer!!!

 

thing is methinks, i'm not going to be able to respond with acceptance/non-acceptance before my aq's due on the 4th anyway so i've still got to go ahead with it regardless.

 

but i'm so excited that 'an offer' of some description is coming my way
