    • I live in a student house, with 5 tenants, unihomes is our utilities provider, who we each have a direct debit set up with and have paid each bill every month. Two letters were sent in my name by BWLegal saying I had two outstanding payments due adding up to over £3500, I have tried to contact british gas (as that is apparently our houses provider) as well as Unihomes. Nothing has helped and BWlegal are pursuing legal action if these debts are not resolved by the 1st May. What do I do? I've called Bwlegal when i bring up that the debt isnt for me and for unihomes they hang up on me. so I am stressed and do not know what to do

    • Hi, everyone. I received a letter from TfL investigator/Prosecutor. The letter reads as follow:   ''Thank you for responding to our enquiry letter. Your comments will be taken into consideration when reviewing whis case and we will contact you as soon as we have reached a decision. TfL now consider prosecution against passengers who are in breach of all TfL byelaw offences and I must inform you that further legal action may be taken. TfL byelaws can be found at ... Please do not hesitate to contact me if I can assist you further.''   The letter was sent 23 days after I replied to them. Should I send another begging letter to IAP? I'm extremely scared now. Thanks all.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all. Well I have just contacted the Court who have confirmed receipt of my letter and that it has been sent up to the Judge. They have no guarantee as to when he will see it because he only deals with correspondence between hearings. They would only say that there is quite a backlog and that it would be dealt with in the next three weeks. Well that's great - the stay is up on 27 June so absolutely no quicker by writing a letter. I did explain that this had been stayed for 9 weeks and was there no way of getting it looked at sooner and she told me that official forms i.e defences always take priority over correspondence - so will have to rely on receiving a letter from Barclays at the end of the week!

 

Have done all that I can now.

Cannot believe it. My letter worked. The Judge has lifted the stay and set up an allocation/directions hearing in its place for 10.00 am on 27 June. I am absolutely over the moon. The courts listing office told me that she didn't think he would look at the letter this week and I already have a response.

 

Should I email Kate and inform her of developments or just carry on waiting. She said a letter would be with me by the end of the week but nothing has arrived as yet. I feel like I am getting slighty closer now.

Get onto to Litigation telling them you have got the stay lifted due to abuse of the system and now have a court date, do they want to continue?

I can sense a huge smile on your face.

Thanks as ever Dar£n. I am certainly walking around the office with a big goofy grin. I can't believe the Judge paid attention to my letter and then set a date for this soon. I think I will inform Kate and ask when I can expect to receive my letter as I will need to send bundle and book the day off work. See what response I get.

Just emailed the following to Kate:

 

Dear Ms Ashton

I have not received anything from yourselves as yet. Could you please confirm when this letter will be sent as I need to book a day's annual leave from my work to attend the hearing on Wednesday 27 June (which I will then need to add to my claim for any settlement figure). I would also like to arrange delivery of my court bundle to you.

I have just had a really awful thought. A week ago I sent off a letter to the Judge asking him to remove the Stay on my claim. I received a letter today stating that this had been removed and a hearing had been set up for 27 June 2007. I didn't send Barclays a copy of this letter - should I have done this and I am also assuming that the court will send a copy of the order to Barclays re lifting of the stay and the court date.

Dont worry about it, Barclays will be notified about the court date anyway.

 

It'll all be over with by then...

I do hope so Dar£n I really do. I have never had such an excruciating time just waiting around for other people. I have got to be the most impatient person ever.

 

Thank you so much for all your helpful advice - I don't know what I would have done without all your help.

 

Talking about waiting I have still had no response to my email to Kate 4.5 hours ago (surprise, surprise!).

 

You would've thought she would deal with me quickly just to get me off her back - I shoudl imagine I have been a right pain in the backside the last 2.5 weeks.

Kate has just emailed me enclosing my settlement letter offering to settle in full. Anyway I have crossed out the bit about confidentiality and said I will let the court know when I have received settlement and now am just waiting for the monies to be received into my account.

anyway am now off to carry on dancing round my office and to let my hubby know etc!
