    • i'd say put lowells to strict proof of where the payment came from. cant hurt to send SB letter, even if proved not. at least they get your correct address. they'd have to link the old IVA times scale to a payment  these IVA F&F pots (if thats where it came from) most mugs dont even know they are not only taking most of your payments on fees but also creaming money off to supposedly offer F&F's.  funny when the IVA fails or is complete these sums of money in F&F pots never get given back or even mentions... these IVA firm directors esp with regard to knightsbridge and creditfix were fined and struck off more times than Paul Burdell of Link Fame and still managed to continue to scam people.
    • Hi everyone, I received a charge certificate with a charge of £165  in April 2022 however I never received a PCN and NTO before that. I responded by requesting original PCN reissued in the hope of getting discounted rate which was refused however I was offered to pay £110. I received an Order of Recovery in May 2023 and submitted a witness statement on time by email to get the original PCN re-issued. I received a Notice of Enforcement in February 2024 I contacted TEC that I had submitted TE9 on time and they advised me to submit a late witness statement and TE7. I did as advised and also attached the original email and witness statement as proof to show that I had submitted my witness statement on time. The council disputed my late witness statement by saying that I likely received the PCN and that I did not submit a valid late witness statement without specifying why it's not valid. The court refused my late witness statement without giving any reasoning behind their decision (so much for the transparency). This is really outrageous as I did attach the proof of submitting the witness statement on time and it seems like the court just decided without looking at the case files. Can someone please advise me what should I do now? Any help is appreciated. I have attached all the documents below.   Documents.pdf

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Greetings all,

 

I have been inspired reading the threads for last few weeks and would like to say everyone seems really helpful & supportive.

 

Following 3 S.A.R’s - (Subject Access Request) to Nationwide I am now in possession of statements for 3 Flex Accounts; my wife’s, our joint account and my own account. Using the magic spreadsheet I have put together the charges for all three and I’m about the send the prelim approach for payment letters.

 

The reclaims for the individual accounts are pretty straightforward (£290.00 and £710.00). However, I’m struggling with the claim for our joint account as back in July 2006 (in the days before I discovered this amazing site) I telephoned Nationwide to complain bitterly about charges I had just discovered on our statement. They very kindly (!!!) agreed to refund the charges and having now carefully checked the statements they were indeed refunded for the July / August 2006 period. However, since then we have incurred further charges and I now want to claim for these and the charges prior to July 2006.

 

When putting together the schedule & spreadsheet I have been extremely careful not to include the said charges already refunded. My concern is that Nationwide will say that as we have previously accepted a refund we have forfeited our right to any future claim. However in my defence, when I submit the schedule and spreadsheet, I can clearly demonstrate that I am not seeking to recover these costs. I appreciate I may have waffled in this thread but please forgive me as I’m a relative newbie! Any advice on this matter would be most welcome and much appreciated. :)

Hi, I wouldn't worry about it just put the claim in as normal. The rest of the charges are still unlawful whether they have already refunded some or not!

Like wot Kirsty says!

 

Think about charging interest on the "charges interest" for the period that they have debited the charges from your account also.

 

Perhaps U could post a link to a download of your "magic spreadsheet" so that others less skilled may also benefit from your expertise?

 

I for one, haven't a clue of EXCEL beyond my ECDL I gained several years ago...have never needed it until now!

 

The heady world of which spreadsheets to use doesn't seem to be a finite one. Both Vampiresses and Mindzai's seem to be popular.

 

...though there doesn't seem to have been a direct comparison of the merits and workings and ease of use of any of their spreadsheets as of yet, which would be reallllly useful!!!

It good to know we are not alone in this process. To be honest I have never used a spreadsheet before - I'm just fumbling my way along! The sheet I used was in fact from Vampiress collection; England - Simple - Excel. Very simple even for me!

Well I can't find Mindzai's spreadsheet!

 

Mindzai's spreadsheet can be found via a link in his signature on the GENERAL forum page in the thread entitled

 

"A New Way of Looking at Interest- 1st Successful Claim N'wide"

 

(...sorry don't know how to set up direct links on here)

 

His latest version is v1.7...the thread is very long as loads of people have discussed the using of Compounded Contractual Interest and spreadsheet modifications etc

 

I would DEFINITELY recommend reading the whole thread at least twice to get the gist of it!

 

Mindzai's spreadsheet can easily be found on page 11

 

I found it very user friendly when I practised using it...I admit that I haven't used any of Vampiress's ones yet so I can't really pass constructive comment on hers.

initially............

I sent in a list of my charges with the dates, the "crimes" and the costs with a total at the bottom.

When it came to the court claim and working out the interest owed, I used this

to work out the interest, copied and pasted the results into wordpad and printed.

I sent this to the courts "by way of service".

worked for me!

Looks like U used the S69 Statutory Interest Rate of 8%

 

Try downloading Mindzai'sspreadsheet (...by following my directions in post #6) and enter the same dates and charges etc that U made for your successful claim.

 

It's very user friendly and even has instructions on how to use it and fill it in.

 

Use 24.9% APR and it should give U Natiowide's Daily Compounded Contractual Interest...Dependent on when your charges were for U should notice a bit of a difference!

 

P.S. How do U do the link thingy?...Can't find any user instructions anywhere...only know how to do colouring books!...lol...;)

Yea I did only go for the 8%

To copy a link into a page: minimalise the page you are on, open the page that you want to send the link for, copy the address and paste it back into the page you minamalised...........does that make sense? There are probably far easier ways of doing it, but Im a self taughter and this is how I do it!

Try it out d and let us know how much more U could have re-claimed from Nationwide...just by applying the same logic of charging that they have charged U instead of using S69 Statutory Interest @ 8% other than stating it as "in the alternatve" on the court forms.

 

Am sure 15moorside would be interested to know the implications of either way...BEFORE he submits his LBA/MCOL?

Apologies for not posting to keep this thread updated! Have finally taken the plunge and sent off three preliminary approaches for payment for each of the flex accounts. Letters were actually sent, by recorded delivery, on 13 December. So let battle commence…:D
