      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Seems some are seeing some difference here - seemed just the usual to me.

 

Maybe his plan is, Incompetence doesn't get me out, corruption doesn't get me out, perhaps mental health issues might get me out before I have to deliver something worthwhile, or at least before Brexit reality really kicks in?

On top of breaking the promises for a high speed rail link in the north, the leveling up/covering the drop in money from the EU promises - out the window

Too true HB, particularly when you look at johnson 'the corrupt incompetent liar's proposal that UK border force would effectively 'manage' the french forces on French soil - sovereignty? ...

 

.. as you say when many of the alleged traffickers are allegedly in the UK using UK financial systems to manage the proceeds from the trafficking ... allegedly  ..

 

I think Johnsons just trying to run it all out until the brink of an election - I also think that the corruption stink has somewhat curtailed Johnsons plans for an early election - he'll be hoping if he ignores it it will all just blow over and his rating will bounce back up again - although God knows why he has any ratings other than pi** off you lying corrupt piece of s*** is beyond me.

Oh - and I think far more than simply withdrawing from the Touqet agreement - a full blown trade war with sanctions is on the cards - Johnson has brinked it hoping the EU would crack (and they did offer some concessions which Johnson/Frost rejected) and backed off

 

Johnson is after an election - I really do think he'll be relieved if he loses ..

Given we are largely where the Brexit johnson and the Brexiters have defined would always have put us, - why wasn't all this sorted and organised before the referendum, let alone before we left the EU?

Lets never forget that Brexit was sold on 2/3 main points 1 positive, 1 negative ...

+ maybe one other which could be either depending on the approach but was tied to the negative point

The positive point in reality always clashed completely with the other 2.

 

 

1. Positive - extra money for the NHS/social care (which is massively populated by immigrant workers)

Apart from Covid, where huge sums were routed to Not-the-NHS for crap PPE etc, the real NHS has continued to be defunded and run into the ground with nothing but rank lies claiming dozens more hospitals built/being built

 

2. Negative - Hate immigrants/foreigners

- which continues unabated with Patel being the front monster  ... despite those 'foreigners' picking the crops and caring for our sick and elderly and working in our hospitality

 

3. Sovereignty and the UK as a world leader - and quite specifically NOT a low tax, low regulation Singapore-on-Thames

- Sovereignty and world power - Truss and Frost - please give us a deal - any crappy deal - and protect our borders for us while Tax free ports are created, taxes increaes to pay the PPEPals and human and environmental rights are trashed with sewage poured
 into our waterways

Tory party falls out with the PM

It’s the day cabinet ministers dread: the publication of the monthly Conservative Home poll of party members.

 

Liz Truss and David Frost top the net satisfaction league table again, but there have been some dramatic swings to “dissatisfied” since last month. Mark Spencer, the chief whip, has suffered the worst, acting as a scapegoat for the disastrous attempt to bail out Owen Paterson, with a 29 per cent swing to minus 21.

 

Boris Johnson himself is the next big casualty, an 18 per cent swing to minus 17; followed by Priti Patel, a 13 per cent swing to a “net zero” satisfaction rating, thanks no doubt to Channel crossings; and Jacob Rees-Mogg, also implicated in the Paterson error, who suffered a 10 per cent swing to a reduced rating of plus 34.

 

Rishi Sunak, on the other hand, seems to be recovering slightly from making the Conservatives the party of high taxes, with a bounce back from a plus 45 rating to plus 53. 

 

The Con Home poll is not a representative sample, but it is restricted to party members and has a good track record of predicting leadership election votes. The August poll was also a good predictor of who was going to be sacked in the September cabinet reshuffle, but now the prime minister himself is second from bottom he would have to sack himself.

 

 

 

So the CONhome Tories think Truss and Frost,  lead negotiators of the UK's EU task farce and the Australia gets the benefits trade deal are the Trouts scallops

Easily pleased is all I can say. (Not that theres much to chose from)

I see the Tories held their safe seat on Old Bexley and Sidcup ... but with a very encouraging 10% swing to Labour and a massive 75% fall in their majority after losing one of the remaining 'real' Tories to the blight of cancer.

 

The upcoming North Shropshire by-election after the resignation of corrupt self serving (allegedly) Paterson is the definition of a Tory safe seat. Peterson might even have snuck a re-win in if Johnson hadn't thought another tory candidate removes the risk.

Be interesting to see the result though.

and regarding Paterson, Is it true his 'relationship' aka paid lobbying from Randox has 'ended'? (Fired as now useless?)

 

.. as Randox has now been pulled up for LOOOOONG not meeting UK consumer and legal requirements

.. which Randox are now addressing (well some of the blatant consumer rights abuses if not the other crap) now they dont have a Paid Populist MP protecting them.

 

As it also becomes clear Johnson and pals were throwing Christmas parties (no doubt paid for by Randox and suchlike) while we were all told we couldn't even talk to our grandparents over a fence ..

The BBC has spoken to someone who attended the party at Downing Street on 18 December reported by the Daily Mirror this morning. (See 9.30am.) According to the BBC, the source said “several dozen” people were there, food and drink were laid on, people played party games and the event went on until past midnight.

No 10 is looking at a “fresh war” with judges to let ministers “throw out any legal rulings they do not like”, according to The Times this morning. The newspaper claims Boris Johnson is keen to prevent the courts from overruling ministers through judicial reviews. One option is said to be an ‘Interpretation Bill’ to strike down findings the government is not too keen on.
