    • That's fine.  The important thing is to show Kev you're trouble and so best to drop you like a hot potato. Invest in a 2nd class stamp tomorrow - all Kev is worth - and get a free Certificate of Posting from the post office.
    • Do not under any circumstances plead guilty until we know what we are dealing with. It's a sure way to 9 points. The tried and tested way to handle this is to plead not guilty to both charges and offer to plead guilty to speeding provided the "Fail to give information" charge is dropped. But I am concerned about this "ticket refused" sticker. I've never heard of this before. A "ticket" is not a term used in connection with speeding offences. There seems a distinct possibility that your response was received by the police but one thing worries me: I've never heard of a sticker being placed on a response and it being returned "Return to Sender". t's just not what ticket offices do. If you could post a picture of this document and the sticker it might help.  If you can show the response was received you may have a defence to the "Fail to Provide" charge (provided you completed your response properly). If the police are saying you did not respond they cannot succeed with a speeding charge (as they have no evidence you were driving). But if you did not respond, who put the sticker on the document and sent it back yo you?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, after my success in getting money back from HSBC, have now started with Nationwide for my partner.

Prelim will be sent today for £3090.50.

Would love this to be as quick as HSBC were - 16 days but have a feeling this ones going for the long haul, he has opened up a back up account with Halifax ready!!

Hi Zola, and welcome to the Nationwide! If past results are anything to go by, it shouldn't be too long a process. The biggest delay usually is waiting for the statements but it sounds like you already have them so that won't affect you. Stick to your timetables and ignore theirs as they will try to stall you wherever possible.

Was quite impressed with the statements, they arrived in a binder all in date order, so thanks Nationwide you saved me a job of sorting them all out hence got my claim into you that bit quicker :p

Just a quick update, received the standard fob off letter it seems most people have recieved so am about to start MCOL.

Have it all filled in will double check it tomorrow, pay and off it goes.

Finally got to filing through MCOL (due to house move, lots of stress and no internet Arghhhhh).

Apparently it will be deemed served on the 14th, other half is a bit nervous now.

 

On the plus side the 8% interest is a fair amount!

Well it seems Nationwide are following a new pattern, we have had just over 3000 paid into my partners account and have now received the letter saying that is all we are getting as there accounts are different to ours. I have double checked our figures, and so has my partner before we started so I am sure they are right, leaving just over 1000 outstanding.

 

What happens now? we have had the court papers back to say they are defending the claim, and they have 28 days from being served to do this so do I wait for the defence and take it from there?

 

Is it worth emailing and writing to Mr Bacon to try and get his figures, as from what I have read they do not seem to be very forthcoming with supplying them. Is that because they are bluffing do you think???

 

Any advise would be much appriciated. Thanks

Hi a bit of help if I may!

 

We are claiming £4500 from Nationwide - including interest. Went to MCOL and they refunded about £3200 saying by their calcs that is al we are owed, blah blah, which I was expecting through other peoples responces.

Received the docs from the court today saying this is all we are owed going back to November 9th 2000 - have asked for their calculations which I am yet to receive.

Now going through the statements they sent my amount is correct but have noticed the statements go back to March 2000 and I have added those to the amount I am claiming which is over 6 years - I did not notice this as I presumed they had only sent me 6 years worth, and when I was adding them to the spreadsheet it did not compute!!! what are the implications of going slightly over the 6 years - could I argue for that? if not then their date of the 9th Nov is about a week before I issued through MCOL however the date I sent the prelim letter was 5th September, so surely I can get the charges back as from 5th Sept 2000 (exactly 6 years), which would make their calculations wrong?

 

Also, have received the close of account letter this morning - can they close the accound and pull the overdraft back while we are in dispute - not worried, have the o/d covered and in the process of changing direct debits over to Halifax, just want to make it as difficult as possible for them :razz: !!!
