    • I'll get my letter drafted this evening. Its an item I sold, which I'm also concerned about, as whilst I don't have my original purchase receipt (the best I have is my credit card statement showing a purchase from Car Audio Centre), I do unfortunately have the eBay listing where I sold it for much less. But as I said before this is now a question of compensation: true compensation would seek to put me back into the position I was in before the loss ie: that title would remain with me until my buyer has accepted this, and so compensation should be that which would be needed to replace the lost item. But in the world of instant electronic payment, it could be argued that as I had already been paid, the title to the goods had already transferred, and I was required to refund the buyer after the loss. And so, despite my declared value being the retail price - that which is needed to return me to my pre-sales position, the compensatory value should be the value I sold it for, which being a second-hand item from a private seller is lower

    • Also, have you told us how much you paid for this vehicle? Are there any other expenses you have incurred – insurance, inspections et cetera? How far away from the dealership do you live?
    • In fact I see that in the document you posted above – your letter to big motoring world you refer to the diagnostics report and you say that you sent a copy to big motoring world but you haven't let us see it. Any reason for this?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys

 

Any advice on how I can get rid of a CCJ issued by PRAC Financial?

 

My credit report states that the default on my loan with Payday UK (whose debt Prac has acquired) is Satisfied as of Jan 2017. Another credit report says its closed. Unfortunately these clowns still want their pound of flesh.

 

Ive received two letters. One from Northampton County Court about the CCJ and one from BW Legal saying I pay the amount of £1,029.

 

I dont want to pay another £255 to set aside. I dont want to pay anything to remedy?

 

What should I do?

 

Maybe write to the court?

when a creditor sells on a debt they mark their file as satisfied with a £0 balance.

 

the debt still existed...

 

I will assume you moved, didn't tell your creditors, and they got the backdoor CCJ with everything filed to that address, which is quite legal.

 

not sure you can do anything sadly, unless you didn't owe the money?

ran away? if i ran away Id be a sunnier climate.

instead im still in london on this forum trying to sort this money I don't owe but has been labelled as a default.

 

Orange did the same (another debt I didnt owe)and realised the error if their ways by cancelling the debt.

 

I expected the same of PayDay Uk. how wrong was I.

 

sorry if wasn't clear.

 

i thought with time it would disappear. ive disputed this loads of times but it hasnt been removed from my credit file

did you send PDUK an sar before they sold it on

why do you think it was paid off?

was it part of a refinance chain?

 

sadly although not nice, they are within their legal right to sell it onat anytime

what puzzles me is how come the fleecers got a CCJ you knew nothing about?

 

did you moved address and not inform people?
