    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • no they never allow the age related get out, erudio are masters at faking supposed 'arrears' fees which were levied before said date and thus null its write off. 1000's of threads here on them!! scammers untied that lot. i can almost guarantee they'll state it's not SB'd too re above, but just ignore them once sent. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Quick question.

Friend of mine got a CCJ in October - 15K, unregulated debt - payment "forthwith"

 

She applied for a re-determination for time to pay.

 

Because of her low income (but high equity in her property), the judge would not make an order to pay by affordable instalments, and refused the re-determination.

 

I understand that there is a window of 28 days for immediate payment to be made before further enforcement action is taken.

 

Is this from the date of the original judgement or from the date of the redetermination hearing?

 

I want to believe its from the redetermination hearing, but am worried that it's from the original judgement (otherwise one could effectively delay enforcement for months, if not years, by reapplying for payment changes)

why didn't she defend it?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Because of her low income (but high equity in her property), the judge would not make an order to pay by affordable instalments, and refused the re-determination.

 

I understand that there is a window of 28 days for immediate payment to be made before further enforcement action is taken. Too late now 3 months old

 

Is this from the date of the original judgement or from the date of the redetermination hearing? Original date.... the redetermination was dismissed/done in error

My mistake.

N245 was submitted - I was under the impression that any request for a change of payment schedule was a "redetermination"

 

She had no realistic prospect of a defence.

 

So enforcement can be immediately then.

Oh dear.

No its a variation...a redetermination is when the judgment is already set at monthly payment and you admitted the claim or partial admitted....and you wish to reduce/increase it.

Because of the amount in question sounds like the judge took a view that the judgment claimant would be better placed to seek a Charging Order as a means of security/ enforcement.

That's what happened.

 

Friend extended her mortgage to pay the ccj

 

She's planning to downsize this year, so paid it off rather than have the uncertainty of what enforcement action might be taken.
