      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Pursuing abbey for nearly £4k. Before I even received a reply from them I noticed they had credited £925 to my account. Sent lba letter saying I would take this as part payment but would pursue remainder. Received another letter from them saying it was "a gesture of goodwill" etc etc and they can do no more for me. Please advise next plan of action?

Hello and Welcome

First of all don’t panic - you will soon have ALL your money back in your hands where it belongs!!

Remember the banks have acted unlawful you haven’t!!!

Before you start anything make sure you read the FAQs and as many threads as possible as there is a wealth of information on here!!

Before you begin, make sure you start your own thread in the bank forum you are claiming against. Here you will have other “experts” who know how that particular bank reacts. As you have already posted this one, I assume you already know how to do that!

Remember its important to open a parachute account, especially if the charges are spiralling out of control and you have little or no money left, at the end of each month.If your account goes into a negative balance after you have transferred your banking, send them this notice to prevent them taking any further action.

If you get stuck have a look (by searching) to see if your question has already been asked by reading other people threads, if you are still not sure either post your question in your own thread or PM me and I will be happy to help you.

Also look for another newbie claiming against the same bank as you, that way you can do your claim together and support each other as the post drops through the door!!

Sometimes the banks act awfully and you can get very stressed out by it all. But stick to your guns - you are in the right - they are not. Don’t let them put you off, that’s what they want to do!

Hi there

 

Thanks for your reply. I am new to the site and don't really know how to post a thread in the newbie section - can you give me details. I found it difficult enough to send this message and have no idea how I did it! Do you think I should type a letter to Abbey saying that I am now going to do a court claim? Is my next step to fill out the form in moneyclaim and send it to the bank.

Hi Haliali To post in the newbie forum is not what you want to do as not many people will see your thread. This is the welcome forum the abbey forum is here: http://www.consumeractiongroup.co.uk/forum/abbey-bank/ If at any time you are stuck and want to see a list of all the various forums on here, ie the banks, consumer info, FAQs etc, then scroll to the top of any page and click on the large CAG icon in the top right hand corner.

 

I do'nt know exactly what leters or process you have followed butas long as you have given them notice that you are giving them 14 or going to court then this would be classed as your Letter Before Action.

 

I suggest that you have a read of the FAQs, this contains a step-by-step guide and we also have a templates forum with standard letters to use. Go to the Abeey link click on New thread and introduce yourself then take a few days to familiarise yourself with this self help site, if you get really stuck then post a question on your own personal thread and someone will assist you. :)
