hi folks

im writing my rejection of settlement (well copy and pasting most of it from the template)

 

it says in it something like please refund me all charges against my account, but nothing about the interest im now claiming as it is filed with the courts and nothing about the filing fee with mcol (80 quid) do i just add these to what i want paid back to me....

 

my cpr 18 answer is due back end of this week along with my aq if that matters in anyway to your answer....

 

can i also flat refuse the whole thing i dont want to take any in partial settlement i want the whole lot in one to save confusion, ???????

I itemised and totalled everything they owe me. Charges, interest, 8% up to today, court fees, Data Protection Act fee etc. etc.

 

This was a wise move as they knew exactly how much to write the cheque for :D.

 

I assume you know how to file AQ and refuse to answer the Part 18 - there are stickies for this above.

NatWest Charges: £3708.81. Allocated to fast track 14/10/06. *SETTLED IN FULL* 23/10/06 5% donation made

 

HSBC Default Removal and £186 charges: N1 claim issued 28/11/06 *WON* 28/02/07 5% donation made

 

Egg Charges: £370. N1 claim issued 24/11/06. *SETTLED IN FULL* 12/01/07 5% donation made

 

Natwest Student: £150. N1 claim issued 24/11/06. *SETTLED IN FULL* 10/12/06 5% donation made

Natwest Credit card: £317.01 INCLUDING CONTRACTUAL INTEREST, *WON* 30/11/06 5% Donation Made

 

Ikano Data Protection Act deception and non-complience: N1 claim issued 28/11/06. *SETTLED IN FULL* 12/12/06 5% donation made

Thank you for your letter dated 09-11-06 I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £960.43 which includes interest at 8% as shown on my charges schedule , I also request the amount of £80 which filing this claim cost me.

 

Grand Total £1040.43

I trust this clarifies my position.

Just a small point - I would use the word "require" rather than request as it is your right to have it refunded. It's not an option for the bank not to pay it to you.
