I've been saved the additional time and money of doing a DPA request as I actually managed to find all my original statements going back to when I opened my account.

 

Total is £468, so sending prelim letter first thing tomorrow.

 

My balance is actually only £297 so I'm not sure what will happen when they pay them back. I presume they pay it back into your account although mine has been suspended so if they do this I'll close the account anyway.

Sent prelim today. Total £545.64 including contractual interest at 15.9%. Nearly sent of the LBA first as I downloaded the 'letter for credit cards' from the library thinking it was another version of the prelim one but it's actually an LBA.

 

Anyway, all sorted, double-checked and posted.

Good luck, I'm still waiting for a response (other than the standard "we'll get back to you within 4million weeks") and my LBA is going off tomorrow!

No reply to my prelim letter, so LBA goes off today.

 

Considering calling them up next week after it's arrived as other people seem to have had success doing this.

Received reply today, the day I was going to do the MCOL thing as well.

 

Bla bla bla charges are fair, etc. £350 payment in final and full settlement and a threat to close the account if I go to court (it's only at £260 anyway so I'm not bothered about that).

 

Wondering what to do now. Might call them today to try and get the rest out of them, otherwise it's claim time.

i would be cheeky and explain that you are due to write to them accepting their offer as a partial settlement only and let them know you intend to submit your courts forms on x date for the remaining amount. I wouldnt give them too long tho, they may think you are not willing to go to court. Remember its your timeframe not theirs, and to prevent court action you want full payment. good luck

I sent them a very simple letter stating I was accepting the payment only as a partial settlement and I am giving them another 14 days (got to allow for christmas really) before I start court action.

 

The account ha snow been cleared and I should get a cheque for the remainder within 10 days. At which point I will close the account anyway.

An update - haven't heard anything since my last letter accepting partial payment. The cheque turned up so now they owe the rest which is £195.64.

 

Once the cheque clears I'll use the money for the court claim. Does anyone have an idea of what the fees will be for this based on the claim amount?

MCOL fee is about £120 I think. You will get this back when they settle though. And make sure you add your interest on when you fille your claim.

 

Templates for the claim form are in the library.

 

I'm chasing MBNA for the remainder of the £258 they owe me. They sent a cheque for £140 which I have accepted as partial payment!

The fee for a claim of that amount is only £30.

my apologies. i presumed it was a flat fee. i paid £120 when claiming against Nationwide. i'm still pretty new to this so any advice is greatfully recieved

It is £30. For anyone interested you can fill in details and then save the claim for a later date. You can change the claim amount around and calculate the fees if you want to know what it will be for different amounts.

Update - Received a letter on Saturday (MCOL was going to be done today) saying they will pay the rest basically, not admitting liability bla bla bla.

 

At least that saves me having to find the court fee.
