      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The four catalogues are the easiest, in fact the other debts, are all non-priority debts. Meaning that they fall right to the very bottom

of the list of people to pay, this is after you've had a good night out on a Friday and paid the chauffeur, and had your bi-annual holiday in the Bahamas!

 

A new bank account is a DEFINITE! Open one with a different banking group, try Co-op or even the Post office.

Although I did bump Lloyds a few years back and switched to Halifax (who own Halifax) and so far so good!

 

Do your own I&E form linked above in Stig's post,

Then get onto the bank and the catalogues and inform them you're in financial hardship, and you want them to work with you in order to

come to an amicable arrangement to pay, but this will be at an amount that YOU decide, NOT them.

Those that don't or won't help, get £1 a month end of.

 

Is there any PPI on any of these accounts?

Do you know how much charges have been added to the accounts?

I have just opened up a new basic bank account online (yeah) so when I get the documents through the post I will then transfer all my bills/payments over then send the Natwest and the rest my I/E which I'm nearly finished.....

That email the sent made me laugh, god only knows what calculator, sorry, Abacus they use to magic up those repayment figures.

 

Personally and IMO, they like to use the threat of I&E forms simply because they like to feel in control, it really is up to you whether or not

you wish to send them one, again purely IMO I have never sent any tin pot DCA or OC an I&E form, all I have ever sent them is

INCOME:£750

OUTGOINGS:£745

Creditors x 5= £1 per creditor.

OFFER £1 per month, your agreement is not required, payments wills start on dd/mm/yyyy for the foreseeable future,

or until my circumstances change.

 

As has already been said, ONLY a judge can request sight of your confidential private I&E, not some joker who has only just

been promoted from flipping burgers in the golden arches.

 

They don't like it because the control and power has slipped through their fingers.

They forget to remember that none of these debts are actually priority debts, and I always remind them of this fact, and if needs be,

I tell them that as I am a bit of a social butterfly, I need beer tokens for the weekend, and anything I have left after my wild parties,

curry nights, festivals, etc will be divided up between the other creditors.

 

As they still fail to help customers in financial difficulty, even when you have informed them of this, they should be told one last time to accept your offer, or you will drop the offer of repayment down to £1 a month for the life of the debt.

I wont let these people dictate that what is best for me is making them number one in my list of priorities..

...much to the detriment of my own and children's lives...

...sorry children, no dinner tonight but we can all be happy with the thought that we have met Vanquis' payments this month.

...it's crazy to think that I was actually putting the credit card company before my own children's needs..

 

It is indeed, but this is how these outfits operate, they make a play on words threatening and intimidating those who owe a bit of money,

it's called ''exploiting a debtors lack of knowledge'' and they know it & exploit it to the extent that some debtors put themselves six feet under.

NO-ONE should ever ever be afraid of these powerless parasites, they have NO LEGAL powers whatsoever!

 

If you can live with their harassment, which you document in a diary before reporting them to your local cop shop

for the criminal offence of harassment, then their attempts to threaten and intimidate you should be seen for what they really are,

a desperate attempt to earn a profit, because money is like oxygen to them.
