Hi folks! first post so be kind :-)

 

I recently received a copy of my credit report for the first time.

 

 

There was an entry for "Lowell communications" for a defaulted account, for £1102.

I called Lowell to enquire

 

 

they stated that the account was for a debt for O2 and was passed to BPO collections some time ago

and that I would have to speak to them about the debt.

 

I have not called BPO or written any letters at this point.

 

Upon further examination of my credit report it states that the default date of the account is 22/02/2010.

Since I live and have always lived in Scotland, and the debt is now 5 days over 5 years old,

 

 

would I be able to state that the debt is unenforceable and request for it to be removed from my credit file?

 

Also... (one last question)

 

I have a defaulted account for CIT group for an account with Dell Finance.

The account was defaulted 28/10/2009.

Again, past the 5 year date in Scotland.

 

 

On my experian credit report it says the account is in "default" however on my equifax report it says that the account is "settled".

Should this now be removed from my credit file also?

I emailed Experian to ask for the entries to be removed from my credit file, seeing as I live in Scotland

and the debts are now statute barred as the 5 year period has passed.

 

 

They have promptly replied and are refusing to remove the entries.

 

 

They have said that they must remain on file for 6 years because the balances were not cleared. Any suggestions?

that is quite correct

 

 

a defaulted debt stays on your credit file for 6yrs regardless.

 

 

sb'd status has nowt at all to do with 'if' they should be showing or not

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

nope read my reply carefully.

 

the clue is the defaulted date.

 

just for clarity re sB...

 

in Scotland, if you were RESIDENT at the time of the credit

after 5yrs the debt is EXTINQUISHED - gone dead parrot

 

in E&W after 6yrs the debt cannot be enforced through the court

but it still exists and is chase able.

 

they can ask for payment

you can ask them to go away.

 

there is NO direct relationship between the defaulted date and the SB date

thanks for replying once again. I'm very new to this, so apologies if I get confused..

 

I've been resident in Scotland my entire life, so because the debt is just over 5 years it is now extinguished, or dead parrot as you said :-)

 

but it will remain on my credit file for another year yet, and there's nothing I can do about that but wait it out?

correct

 

 

All references to a defaulted debt must be removed from your credit files after 6 years

has passed from date of default, whether paid off or not.

.

{the WHOLE ACCOUNT WILL VANISH, never to return}.

 

This is so that someone who continues paying something

- even after 6 years from default

- should not be at a disadvantage to someone who pays nothing after default

and ends up with a clean file after 6 years.
