    • there is never a need to use signed for. it doesn't work to po boxes etc as most firms use mailing centres. follow the guide next time, 2nd class stamp with free proof of posting is all thats needed. do not respond by email phone etc. could there be a case of irresponsible lending here? was your file shot with defaults and lots of lending already in debt when they gave the loan too you? that could be the reason. dx  
    • well make sure you write telling them of your correct correspondence address , they wont do anything nor sell it on i doubt. so they are pulling their old stunt of a managed loan (search here for HSBC Managed loan). they got carpetted for that several years ago. make sure there is zero income going into the od account. open a parachute account pronto is there is. starve them of income, the od can go sing dixy now. is your home jointly owned? mortgaged? just looking to their options should they go nuclear. dx
    • well done.  you know the routine. hold on filing till say 20th ish? get it in before xmas/new year closedown / postage issues. you'll see the sticky upon how to respond to an SPC and you'll need to make ref to the previous failed CCA request. that wont go down well with the sheriff, AYR guys know nolans very well and their tricks. had previous dealing with 2 of the sheriffs there won both.  ps have a look in financial legal issues and you'll see numerous barclaycard claimform threads. BC never give out the cca even for 2015 online signup, 9/10 its fake stuff and claimants try to rely upon recon rules.
    • Thanks, that gives me a bit of comfort.  All onboard at my end: filed, signed and dated - and accepted by the court. They also confirmed they would send the defence to Nolans.  I also posted my defence. Positive I've proof of posting, but will have to do a bit of digging to find it. Clerk reviewing and will get back to me with what to do. Assuming this can be recalled, they've bought themselves more time to uncover the paperwork which they've yet to provide
    • they've pulled this trick several times before. as long as your filed defence has the intimation sheet signed as the last page and a date you'll be ok, sounds like a court mistake here to me speak to the clerk , i cant remember on ordinary cause claims but i think a repone is quite expensive, you shouldn't have to be doing this nor paying for one. how did you serve your defence on nolans just for the record and did you get free proof of posting. dx

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am in, somehow, a similar situation. I moved out of my previous address about 2 years ago. I did a credit check on myself, out of curiosity, last week and noted that Seven trent had defaulted my account with outstanding bill of £60! I contacted them and sent them the tenancy agreement for my new place but they want either letter from landlord confirming I had left the property or a letter from council saying I was no longer responsible for council tax- (apparently you can live in two places at once, although I dont know anyone who is doing that). The problem is that landlord was a difficult guy, I contacted him and he more or less said its not his problem, as of letter from council, I used to receive council tax benefit so not sure if they will provide me with a letter as such, (because I wasnt responsible for it) although I contacted them a couple of days ago and am waiting their response.


This is annoying me a lot, I know its partly my fault as I forgot but I had a clean file for 15 years and paid everything on time. I paid all other utility bills before I left as well as internet and had £200/month loan which was DD and was always paid on time and now I have a default on my smallest bill which I am not responsible for! Its bothering me a lot as I think the default is unfair. Does anyone have any advise on what to do? I told ST I will pay £60 if they remove default from my file but they said its up to debt collectors now, the debt collectors say they never put it on my file and its ST's responsibility and im caught in the middle! I've probably spent about £20 ringing them on their 0845 numbers!


Does anyone know if I have any options? As I had moved house I never received a notice of default or whatever that is. I really want to remove the default, if ST agrees to remove it then I'll pay them the balance but I want confirmation that they will remove that from my file (I dont want just a settled default as they say it still looks bad on your file). At the moment they are refusing to accept that they defaulted my account!

I had this problem a year ago, ring the council and ask for a closed council tax bill for the property in question and send ST a copy, they will then amend the bill and should then remove the default if it is zero balance.


Just speak to someone in the collections dept not the normal customer services part.
